Development of Air Operations Regulations in Europe Joint Aviation Authorities. JAR-OPS 1 (Aeroplanes) JAR-OPS 3 (helicopters). EU-OPS (Aeroplanes). EASA Implementing Rules will replace EU-OPS and JAR-OPS 3. New rules encompass a range of commercial and non- commercial operations. 2
The Air Operations Regulation (965/2012) entered into force on 28 th October Malta will make use of the 2 year opt out period therefore the Date of Application of the Regulation in Malta will be 28 th October In the meantime EU-OPS and JAR-OPS 3 will continue to apply. 3
Regulation (EC) No 965/2012 contains the first 5 Annexes of the Air Operations Regulation Annex IDEF Definitions used in Annexes II to VIII Annex IIPart-ARO Authority Requirements for Air Operations. Annex IIIPart-ORO Organisation Requirements for Air Operations. Annex IVPart-CAT Commercial Air Transport Operations with aeroplanes and helicopters. Annex VPart-SPA Requirements for operations requiring Specific Approval e.g. RVSM, MNPS, LVO etc. 4
The Regulation will be complemented by Annexes VI to VIII including regulations for Sailplanes and Balloons (CAT S & B), A to A Operations (CAT A-A) and rules concerning Flight Time Limitations later in Annex VIPart-NCO Requirements for Non- Commercial Operations of complex motor powered aircraft. Annex VIIPart-NCO Requirements for Non- Commercial Operations of other- than-complex motor powered aircraft. Annex VIIIPart-SPO Requirements for Specialised Operations including commercial and non- commercial operations e.g. Aerial Work. 5

7 Actions by the Civil Aviation Directorate during the transition period. Inform EASA and the Commission of our intention to use the opt-out and submit our implementation plan. Make necessary changes to our Inspecting Staff Manual and Management System Manual. Issue further advisory material to operators by way of Operations Advisory Notices (OAN) and convene additional Flight Operations Consultation Group (FOCG) meetings.
Monitor Operators progress with implementation and conduct visits to individual operators to give advice where necessary. Review Operators submissions of revised Operations Manuals. Check each operators application for the EASA AOC, Compliance Checklist and Compliance Statement. Issue the new AOCs. 8
Actions to be taken by existing Operators during the transition period. Appoint a project leader/point of contact. Analyse the new regulation, associated means of compliance and guidance material and consider the implications for their own operation. Conduct a gap analysis to identify individual areas that would need development and/or adaptation. 9
Devise a road map to ensure that the set target dates can be achieved. Inform the CAD Flight Operations Inspectorate of time scales set for the implementation plan. Adapt their Management Systems, including a Safety Management System and Operations Manuals to satisfy the new Regulation. Submit a notice of proposed amendment for the Operations Manual with a list of changes made to the existing manual. 10
Complete the process for grant of an EASA AOC by April 2014 at the latest – 6 months prior to the expiry of the opt-out. Ensure that crew members and other operations personnel are briefed on the changes that have been made. This briefing, which must be recorded, is to be given prior to the revised documentation being used as reference in actual operations. 11
Advice to Operators Do: Start work now and devise a plan of action. Keep CAD Flight Operations Inspectorate informed. Aim to submit necessary material as soon as possible. Apply adequate resources. Keep in mind that, after the end of the opt-out period, AOCs issued in accordance with EU-OPS or JAR-OPS 3 will no longer be valid. Do Not: Panic! Delay or underestimate the work to be done to obtain the new AOC 12
