6 REGULATORY COMPLIANCE TIMELINE 1. October 22, 2003 – Town receives Notice of Violation from IDEM for failure to comply with NPDES Permit 2. February 13, 2004 – Town enters into Agreed Order 3. September 1, 2004 – Town submits compliance Plan to IDEM 4. June, 2005 – Town submits request to extend Compliance Plan by 3 years 5. December 2007 – Town accepts bid from Alpha Excavating Inc. for $100K (1,945 linear ft.) of sewer rehabilitation work. 6. July 2008 – Alpha Excavating work complete. 7. 14 Current Funding Opportunities… Indiana Office of Community and Rural Affairs (IOCRA): Disaster Recovery 2: Decatur County qualifies as a disaster county Project must be vital to economic recovery of area $50 million available state-wide to disaster declared counties Service area is at a minimum 51% low-to- moderate income (Westport is 56.43%) Without IOCRA Disaster Recovery grant funding, Westport would only be eligible for a $600,000 grant instead of a $1,047,350 grant. (Considerable rate impact to sewer customers)

17 Problem: Replacement of Service Laterals cannot be financed with government grant money due to individual “direct benefit”. Option 1: Under existing “terms of use” ordinance , force homeowners to fix/update their service laterals at their own expense. Option 2: Determine which customers fall within “low to moderate income” category. Use government money to replace their service laterals and revert to Option 1 for everyone else. Option 3: Obtain outside financing (non-government) for fixing the service laterals and then at the end of the project USDA RD would buy-out/assume the loan at a lower interest rate for the town. Option 4: The Town assumes ownership of the service laterals and becomes responsible for upgrading, repairing, and maintaining them. This makes them fall perfectly into the project scope and eligible for all government grants/loans.

18 Steps to implement Option 4 - Town to pass an ordinance assuming ownership of the pipe in the ground for all customer’s sewer laterals. Will happen in Council Meeting at 7 PM. Hold a public hearing on the sewer update project that discusses project details and shows the government funding. What we’re doing right now. Send URA Brochure and notification of project to all sewer customers via certified mail. What most of you have already received. Obtain easements from all customers that gives the town the right to update and/or repair their sewer laterals. Available in the back for your signature tonight. After government funds are allocated/committed, record easements at the courthouse.

19 THE CERTIFIED MAILING Cover Letter States NO land is being acquired. Only Easements are needed for sewer lateral fixes. All 3 enclosures are required because our project is using government funding.

21 THE EASEMENT Available in the back Organized by Street Address Needs to be signed by each property owner and Notarized. Gives the Town the permission to dig-up and replace your sewer lateral. Current schedule shows overall project will start on or about July 2011.

22 SEWER RATE STUDY Completed by Sherman, Barber & Mullikin in Madison, IN Results already forwarded to USDA RD in North Vernon. Study covers $2.1 Million dollar loan from USDA RD. Study covers current project and 9 major components thru the next years.

28 CONCLUSION Doing NOTHING is not an option. We have already paid fines to IDEM and they will not be patient forever. We don’t have the money to fix it ourselves. We’ve paid $100,000+ already with negligible improvement. As your elected Town Council, based on the Engineering Study and the circumstances at this time in our Town, State, and Nation, we believe that this is the proper and best course of action to take.
