Title IX 106.40 Marital or parental status. (a) Status generally. A recipient shall not apply any rule concerning a student's actual or potential parental, family, or marital status which treats students differently on the basis of sex. Both mothers and fathers must be allowed to access supports and services. (b) Pregnancy and related conditions. (sections 1-5) Access to school during pregnancy and recovery from pregnancy (sections 1, 2, 4 and 5) Access to programming for mothers and fathers (section 3)

Access to school during pregnancy and recovery from pregnancy: (1) A school shall not discriminate against any student, including any class or extracurricular activity, on the basis of her pregnancy, childbirth, false pregnancy, termination of pregnancy or recovery from such conditions, unless the student requests voluntarily to participate in a separate portion of the program or activity of the recipient.

Access to school during pregnancy and recovery from pregnancy: (2) A school may require a physician’s certificate from a pregnant student stating that she is physically and emotionally able to continue participation so long as such a certification is required of all students for other physical or emotional conditions requiring the attention of a physician.

Access to school during pregnancy and recovery from pregnancy: (4) School must treat pregnancy, childbirth, false pregnancy, termination of pregnancy and recovery from these conditions in the same way that other temporary disabilities are treated. Any policies or services that are offered to students with other temporary disabilities must be offered to pregnancy related conditions as well. (i.e. if you provide home instruction or special transportation for one disability, you must for all.)

Access to school during pregnancy and recovery from pregnancy: (5) Schools must grant a leave of absence for pregnancy or pregnancy related conditions for as long as is deemed medically necessary by the student's physician. When the student returns they shall be reinstated to the status which she held when the leave began.

Access to programming for mothers and fathers: (3) Schools that operate separate programs reserved for pregnant or parenting students must allow admittance to be completely voluntary on the part of the student and must ensure that the separate program is comparable to that offered to non- pregnant students.

ORS 336.640 Rules governing education for pregnant and parenting students. (1) The State Board of Education shall establish by rule procedures for considering and obtaining special services for pregnant and parenting students. Such rules shall include, but not be limited to, the obligation of the school district to:

(a) Inform pregnant and parenting students and their parents of the availability of such services in the school district, education service district or in the community; Call me to help you locate community services. Identify school based parenting programs in your area by looking at the data base on the ODE website.

(b) Facilitate the provision of such services, including counseling, life skills and parenting education, child care, transportation, career development and health and nutrition services to pregnant and parenting students; Parenting Education Standards and curriculum are available on the ODE website.

(c) Inform pregnant and parenting students and their parents of the availability of resources provided by other agencies, including health and social services; Regional Parenting Hubs Home Visitation Services (Healthy Families/Relief Nursery) Maternity Case Managers DHS – Self Sufficiency Contact Crystal Persi for information on these and other resources in your community.

(d) Provide educational programs and schedules that address the individual learning styles and needs of pregnant and parenting students; and (e) Develop individualized educational programs or services, or both, to address the needs of pregnant or parenting students when their educational needs cannot be met by the regularly provided school program.

(2) Each school district shall adopt policies and guidelines for implementation of this section in a manner consistent with the rules of the state board adopted under subsection (1) of this section. (3) No pregnant or parenting student shall be excluded from the public schools solely on the basis of pregnancy or parenthood. (This ties back to Title IX)

(4) For purposes of reporting enrollments, school districts may count eligible students who are receiving individualized programs or services, or both, as described in subsection (1)(e) of this section, in the same category as students eligible for special education as children with disabilities under ORS 343.035.

(3) Pursuant to ORS 336.640(4), [what we just learned about] the resident school districts shall receive an additional 1.0 times the ADM of all eligible pregnant and parenting students: FYI: Section 1 is definitions, section 2 is Special Education, section 4 is ESL.

OAR 581-23-100 Eligibility criteria for student weighting for purposes of state school fund distribution. (a) To be eligible, a student must be in the ADM of the resident school district and meet the following criteria: (A) The student must be identified through systematic procedures established by the district; (B) The student must be enrolled and receiving services described in ORS 336.640(1)(b) and (d); (C) The student must have an individualized written plan for such services which identifies the specific services, their providers, and funding resources.

(i.e. if they qualify for special education double ADM, as outlined in section (2) they do not qualify for additional double funding.)
