Machine Directive 2006/42/EC: Transposed by the Ministry of Social Affairs and Social Security, 29th.Dec.2009 by regulation 1005/2009 “reglugerð um vélar og tæknilegan búnað”. Is implemented by AOSH, through inspections and Marked Surveillance. In practice the original text (the Directive) is used if any doubt - or if issues araise. A helpful tool: “Guide to the application of the Machinery Directive, 2nd Edition June 2010”. Machinery – Free Movement of Goods

Most frequent cases araise through: RAPEX – “Rapid Alert System for non-food consumer products”. AOSH receives regular RAPEX-announcements through the National Contact Point, the Consumer Agency. The marked informing or complaining. Inspectors noticing lack of CE-labelling, safety breaches, etc. Machinery – Market Surveillance

Example of a RAPEX announcement – Lawn trimmer “Cutter to be fitted to a lawn trimmer. Instead of a rotating plastic thread, there is a rotating disc with two curved steel blades. It is intended to enable the user to trim branches and bushes rather than to cut grass. It is supplied separately as an accessory; it is not supplied along with the original lawn trimmer. The manufacturer is advertising it as suitable for use with all lawn trimmers.” “- the steel blades could fly off due to wear and tear, ageing or overload; - lawn trimmers generally available to consumers do not have a guard that is thick or large enough to provide adequate protection for this type of heavy cutter. A fatal accident occurred with a similar product. The product does not comply with the Machinery Directive.” Machinery – Market Surveillance

The Lawn trimmer RAPEX announcement was received in the Autumn of Actions taken: Suppliers of gardening tools contacted and informed. The equipment not found on the marked. Gardeners contacted and informed. A Press release sent out to inform of the danger. Next spring, before start of the gardening season, the actions will be repeated. Machinery – Market Surveillance

A complaint from the marked – Example The manager of a local company had concerns regarding the safety of a machine he had purchased and was being installed by the supplier. A local supplier. Product from Pakistan – a specially designed machine, producing plastic bags filled with compound to maintain low temp. on food during transportation. CE-marked, no Declaration of Conformity. Safety breaches, lack of guards etc. The supplier had imported other types of machinery from the producer in Pakistan earlier, without problems, but then through a supplier in France. The local supplier called in a third party (a notified body) to help with Risk Assessment, Conformity Assessment etc. Machinery – Market Surveillance

Directive 2000/14/EC was transposed by the Ministry of Social Affairs and Social Security, 31. March 2003 by regulation 279/2003 “reglur um hávaðamengun í umhverfinu af völdum tækjabúnaðar til notkunar utanhúss”. The scope is equipment and tools for outdoor use with exceptions; cars, trains, equipment especially designed for the Police etc. No domestic production, purely import. Mainly a Marked Surveillance issue, no recent cases especially regarding the noise. Comes up in connection with import from countries outside the EU. Machinery - Noise emmissions by equipment for use outdoor

Directive 95/16/EC on the approximation of the laws of the Member States relating to lifts: Was transposed by the Ministry of Social Affairs and Social Security by Rgulation No. 570/2000. Regulation No. 570/2000, after amendment became Regulation No. 341/2003 “reglugerð um fólkslyftur og fólks- og vörulyftur”. Regulation No. 341/2003 has been amended, with Regulation No. 1003/2009. The scope of the regulation is lifts for persons, persons and goods, or goods only – that is if the carrier is accessible and with controls in reach. Machinery – Lifts acc. to Directive 95/16/EC

These are: inspected by a notified body after installation, serviced regularly (service contract with third party*), personlifts are inspected annually by AOSH inspectors, goods lifts are inspected every other year by AOSH inspectors. During the annual inspection it is checked if the regular service has been performed accordingly.* *Regulation No. 54/1995 on registration, inspection and service of lifts “reglugerð um skráningu, eftirlit og umsjón með lyftum og lyftubúnaði til fólks- og vöruflutninga”. Machinery – Lifts acc. to Directive 95/16/EC

The scope is lifts other then those under Dir. 95/15/EC. For instance: stage lifts, lifts for handicapped, lifts for goods (not easily accessible), working platforms, escalators etc. These are inspected annually by AOSH except for the goods lifts that are inspected every other year.
