Request by Center City Public Charter Schools to Redevelop the Nativity Colonnade Room Parish Town Hall Meeting 10 am Saturday, March 10, 2012

Objectives 1.Share the details of the tenant’s preliminary proposal 2.Openly discuss the implications of the potential change 3.Clarify the current restrictions on Colonnade Room use 4.Listen to feedback from the parish

Preliminary Request The first 5 year lease with Center City Public Charter Schools ends with the next school year (August 2013) The original lease provided for a 5 year renewal under the same terms (+rent increase) if both parties agreed As part of the renewal, the tenant has requested authorization to redevelop the Colonnade Room If approved, this expansion for instruction/school space would occur no sooner than summer 2014 The tenant has not completed a feasibility study and only plans to ask for the space that can be efficiently used to better serve neighborhood students

Rent from Charter School

Total Parish Rental Income Prior to the elimination of certain events, Nativity generated roughly $60,000 annually from Colonnade Room rentals That total has fallen by roughly two-thirds in this fiscal year

Use of the Colonnade Room (last four years) The charter school tenant has first priority The lease permits the parish to use the building as long as the events are: 1)Coordinated with the tenant, and 2)Do not interfere with the school Some parish sponsored tenants abused the privilege of using the facility –Reported incidents of abuse –Second chance incident with no alcohol and a midnight close

Response to Historical Use Following the “second chance” incident, the archdiocese introduced a temporary moratorium on use of the space After meetings with all parties, many restrictions were lifted and all parish events may be held in the facility Under canon law, archdiocesan policy, once signed by the archbishop, has the force of law Compliance with policies that are expected to apply to all parishes has been applied in advance of promulgation by the archbishop Parish events at Nativity must follow both archdiocesan policy and applicable laws for the District of Columbia

Permitted Uses ONLY AN ATTORNEY IS QUALIFIED TO PROVIDE LEGAL ADVICE A liquor license is required if any consideration is given in connection with the event (not just if alcohol is sold) or if the event is open to the public If any outside group or individual can rent the Colonnade Room, it risks being found to be a “Public Hall” If the parish were to operate a Public Hall: –The space would become subject to annual real estate taxes; and –The parish would be required to rent to anyone including inappropriate users

Permissible Events Parishioner’s Quinceanera Meeting for a parish organization (e.g. El Shadai) Fashion Shows Events are evaluated on two primary criteria: 1.The nature of the group hosting the event 2.The type of activity which must always be consistent with the teaching and mission of the Church Wedding reception for parishioner Volunteer appreciation dinner (with alcohol) Homeowners Association Mtg Dance/Music Parties Permissible Not Permissible Non-parishioner charitable event for non-archdiocesan charity Borderline events: pastor must consider legal office advice The parish’s ability to continue to use the Colonnade Room is dependent upon all users behaving appropriately

Capital improvements are only be approved if: 1.The tenant requests approval to move forward with a specific design; and 2.After hearing from his parish advisors, the pastor requests permission to approve the tenant’s request; and 3.After hearing from the College of Consultors, the archbishop approves the parish’s request Governance Process EVERY PARTICIPANT HAS A VETO
