FLSA FAIR LABOR STANDARDS ACT

THE FLSA DEFINED FLSA applies to non-exempt employees and regulates: Federal minimum wage Overtime pay 2

THE WORK DAY/WEEK The work day is the 24 hour period beginning at 12:01 am and ending at midnight. The work week is seven (7) consecutive workdays beginning at 12:01 am on Sunday and ending at midnight the following Saturday. 3

OVERTIME PAY The employee’s regular rate of pay, plus an additional half of the regular rate for all hours the employee works in excess of 40 hours in a work week. In CA, overtime is paid for hours in excess of 8 hours in a day. Overtime must be pre-approved by management. 4

TIME KEEPING Time cards must be submitted by 9:00 a.m. Monday following the week worked. Time cards must be signed by the employee. If absent, the employee’s supervisor will prepare the time card and the employee will sign the card upon return. 5

BEGINNING AND ENDING TIMES You are not permitted to report for work more than five (5) minutes prior to the beginning of the work period or leave more than five (5) minutes after the ending of the work period unless requested by supervision on an approved overtime basis. LBJCC can take disciplinary action if you violate this rule. 7

MEAL PERIODS CONT. Nonexempt employees are scheduled for a 60-minute, uncompensated meal period. Employees are free to leave their work areas during their meal period. 8

MEAL PERIODS CONT. No duties are to be performed during an unpaid meal period. In the event of an emergency, immediately after responding, you must inform your supervisor about the emergency and the amount of time spent. 9

MEAL PERIODS CONT. Employees are to turn off their radio during their meal period to ensure they are not interrupted. If a student interrupts you during lunch, politely let the student know that you will help them after your meal. 10

CALL-IN TIME Employees who are called in outside of their regularly scheduled working hours to perform work of an emergency nature are paid for time worked. In no case is such pay less than the equivalent of four (4) hours at the straight-time rate. Only the time actually worked is used in computing overtime. 11

SHOW-UP TIME Compensable If no advance notice, a minimum of four (4) hours at the straight-time rate is paid to nonexempt employees. Unless actual work is performed, such time is not considered as time worked toward overtime computation. 12

WHAT ABOUT COMP TIME? No comp time is allowed—it is illegal in CA. Non-exempt employees must record the exact number of hours/minutes worked each shift. Swapping or trading work time is not allowed without a supervisor’s approval. 13

CAN EMPLOYEES WORK FROM HOME? Non-exempt employees are NOT permitted to perform work at home on behalf of the Company, even if the employee wants to do so voluntarily. 14
