AIM OF THE TRAINING IS TO EXPLAIN ….. why hate incidents are dealt with positively by police and partners. hate motivation definitions of hate crime & hate incidents. which identifiable groups are covered by hate crime / incidents. aggravated hate crime, hate related crime, racial and religious hatred crime & hate incidents). how to deal with hate crime. how to deal with hate incidents stop hate uk’. OBJECT OF THE TRAINING Provide officers with a good understanding of hate crime /incidents Officers will be able to deal with incidents positively. WHY IMPORTANT Training & Development Services (TADS) JODY DOBROWSKI AGE 24 MURDERED 2005 London Jody was walking across Clapham Common when he was beaten to death by Thomas Pickford & Scott Walker Prosecutors said that they had a pre- meditated plan to attack a gay man. Judge Brian Barker said the pair had only one intention when they went to the common – homophobic thuggery They will each serve a minimum of 28 years imprisonment

WHY IMPORTANT Training & Development Services (TADS) Michael Fardon AGE 45 MURDERED 2006 Northampton Set upon because he was GAY. Hyland, the offender, was jailed for 12 years for this murder and another 16 months for attacking a man in the toilets of another gay bar, two weeks before he murdered Mr Fardon.

WHY IMPORTANT Training & Development Services (TADS) Fiona Pilkington (Mother) Francesca Hardwick (Daughter) MURDER & SUICIDE 2007 Leicestershire,, The mother driven by the action of bullies apparently to kill herself and her disabled daughter in a burning car. Her house was routinely surrounded by baying yobs. Her son was locked in a shed at knifepoint and beaten with a metal bar, and her daughter, who had severe learning difficulties, endured the sound of stones thrown at her bedroom window as she went to bed, accompanied by shouts demanding that she lift up her nightdress.

Was it dealt With positively ? Hated Gay and BME people, he must have displayed overt hatred before. Offenders attacked a man in another gay bar 2 weeks prior to murdering Michael. Reported numerous low level crimes and incidents, Some classed as ASB. Often obvious that it was aimed at disability. Turn the tap off before the water flows......

Definition Hate Crime A hate crime is a criminal offence ….. Which is perceived by the victim ….. Or any other person …… To be motivated by hostility or prejudice. Based on a persons race, religion, disability, sexual orientation or transgender. Training & Development Services (TADS)

HATE INCIDENT A hate incident is an act directed against a person(s) based on their actual or perceived race, nationality, religion, gender, disability, or sexual orientation. The difference between a hate incident and a hate crime is that a hate incident is a non-criminal act. Training & Development Services (TADS)

HATE CRIME Racially or Religiously aggravated offences. Statute and cover Assaults, Criminal Damage, Public Order and Harassment. (Does not cover disability, Sexual Orientation or Transgender) IF IT DOES NOT FIT THE ABOVE AND IS MOTIVATED BY HATE Any Offence Motivated By Hate..... Include in the MO and make sure CR! Is noted as HATE. Training & Development Services (TADS)

For example: A person is ABH’d because of their sexuality it is crimed as ABH – hate related A disabled person has her car damaged because the neighbour is aggrieved that she, as a disabled person, has allocated parking – It is crimed as criminal damage - hate related A person receives a telephone call that is racially abusive. It is crimed as Malicious telephone calls – hate related. Training & Development Services (TADS)

HOW TO DEAL WITH HATE CRIMES/ INCIDENTS Listen, Clarify, Check If it is an incident that does not fit any of the hate crime criteria, but is hate related submit a NON CRIME REPORT (If you are unsure of what offence has been committed submit a non crime report – It can always be changed to a crime at a later date) If it is a crime incident, record and deal with it as you would any other incident (Primary investigation) If crime, prioritise investigation Ask CRU to make the Hate Crime DS (North & South) And ensure report is marked “HATE” Update the CMS record before going off duty.
