BMAN 10901: LAW IN A MANAGEMENT CONTEXT Law is pervasive in modern society and nowhere is this more true than in relation to the area of business and management. This module aims, therefore, to provide students with a basic understanding of the English Legal System, its principles and institutions. By familiarising students with key legal concepts, distinctions and issues, it is intended that they will be able to recognise and evaluate the relevance of law to business and management both in theory and practice. To this end, the module compares and contrasts legal mechanisms with alternative methods of dispute resolution, and seeks to place the English legal system within a broader European and international context. It also introduces students to some important substantive legal and policy issues, including business forms, corporate manslaughter, general employer liability, intellectual property, the impact of European Union Law and the legal regulation of the employment relationship. Finally, the course will seek to arm students with a range of basic legal skills and an understanding of how to apply these to business/management examples.

The course aims to give students a sound basic understanding of the principles of individual and collective Employment & Labour Law, together with an insight into the extent to which the law recognises the essentially “social” nature of the employment relationship and the “political” dimension to its regulation. It intends, in particular, to highlight those areas of the subject that are controversial or on which there is current interest, and to explore the ever-growing influence of both human rights and, most crucially, European Union law on the UK domestic legal framework. The emphasis of the course will therefore shift from year to year and, indeed, may be modified during any one year, to accommodate legal and public policy developments.
