Starting & Stopping Work: The rapid reclaim process allow you to re-claim within a six month period without having to provide as much information, this applies to Income Support, Income Based Jobseekers Allowance, Incapacity Benefit, Housing & Council Tax Benefit for Employment Support Allowance the gap needs to be under 12 weeks. Incapacity related benefits such as Incapacity Benefit, Severe Disablement Allowance are linked anyways if any gap in claiming is under 8 weeks. These rules also give you back the same amount as previously paid without having to re-qualify again and it allows the disability premium in Income Support, HB & CTB back right away if paid previously. Any Statutory Sick Pay is also linked if under 8 weeks apart.

Welfare to work rules: If you start work or training after being on incapacity related benefits for over 28 weeks then this rule allows you to return to your previous incapacity related benefit if you fall sick again within 104 weeks or two years of starting work. This applies to Incapacity Benefit, Severe Disablement Allowance and the disability premium within Income Support, HB & CTB. The above rule applies to Employment Support Allowance as well but you only need to have been on this for 13 weeks or more to benefit from this 104 week linking rule

If you have the disability element included in your Working Tax Credit calculation this also gives you 104 weeks or two year protection to allow you to get back the incapacity related benefit you had before you started working. This rule will help people who have DLA but have not served the 28 or 13 week waiting period above before they start working. If no linking rule applies when you fall sick at work then Employment Support Allowance will need claimed.
