Federal Regulations Imposed on the Manufacturing Sector (2013 Update Study) August 20, 2013 All results are preliminary. Please do not cite or quote.

1 Approach  Recent data on federal regulations were obtained through the Office of Information and Regulatory Affairs (OIRA) and the Office of Management and Budget (OMB). –473 regulations from OIRA (from May 2012 through July 31, 2013) –21 regulations from the latest OMB report (October 2012 through September 2013)  The screening methodology employed was identical to NERA’s 2012 study: 1.Based on the Regulation Identifier Number (RIN), count only regulations marked as “Final Rules”; 2.If multiple “Final Rules” are present for a given RIN, count only the most recent; 3.Exclude regulations with Decision marked as “Withdrawn”; 4.Exclude “Proposed Rules” more than five years old.

2 Estimate of Regulations Imposed on the Manufacturing Sector Between 1981 and April 2012 (2012 Study)  U.S. manufacturers today are subject to an estimated 2,183 unique regulations promulgated between 1981 and April Classifying these using the North American Industry Classification System (NAICS), we find:  41 major regulations and 375 non-major regulations are directly related to the NAICS 31 sector, which includes food, beverage, and textile manufacturing.  65 major regulations and 755non-major regulations are directly related to the NAICS 32 sector, which encompasses businesses involved in wood, paper, printing, petroleum, chemicals, and plastics.  185 major regulations and 1,423 non-major regulations are directly related to the NAICS 33 sector, which includes machinery and transportation equipment.

3 Estimate of Regulations Imposed on the Manufacturing Sector Between May 2012 and July 2013  U.S. manufacturers today are subject to an estimated 119 unique regulations promulgated between May 2012 and July Classifying these using the North American Industry Classification System (NAICS), we find:  18 major regulations and 30 non-major regulations are directly related to the NAICS 31 sector, which includes food, beverage, and textile manufacturing.  5 major regulations and 44 non-major regulations are directly related to the NAICS 32 sector, which encompasses businesses involved in wood, paper, printing, petroleum, chemicals, and plastics.  17 major regulations and 51 non-major regulations are directly related to the NAICS 33 sector, which includes machinery and transportation equipment.

4 Estimate of Regulations Imposed on the Manufacturing Sector Between 1981 and July 2013  U.S. manufacturers today are subject to an estimated 2,302 unique regulations promulgated between 1981 and July Classifying these using the North American Industry Classification System (NAICS), we find:  59 major regulations and 405 non-major regulations are directly related to the NAICS 31 sector, which includes food, beverage, and textile manufacturing.  70 major regulations and 799 non-major regulations are directly related to the NAICS 32 sector, which encompasses businesses involved in wood, paper, printing, petroleum, chemicals, and plastics.  202 major regulations and 1,474 non-major regulations are directly related to the NAICS 33 sector, which includes machinery and transportation equipment.
