Informed Consent: Basis The federally mandated requirements for informed consent are grounded in the Belmont Report. Respect for Persons: “Respect for persons incorporates at least two ethical convictions: first, that individuals should be treated as autonomous agents, and second, that persons with diminished autonomy are entitled to protection. The principle of respect for persons thus divides into two separate moral requirements: the requirement to acknowledge autonomy and the requirement to protect those with diminished autonomy.”

Informed Consent: The Document There are eight separate OHRP requirements for the informed consent document: 1. A statement that the study involves research, an explanation of the purpose of the research, the duration of participation, a description of the procedures and identification of the experimental procedures; 2. A description of any reasonably foreseeable risks or discomforts; 3. A description of any benefits to the participant or to others that might be reasonably expected from the research; 4. Disclosure of appropriate alternative procedures or courses of treatment, if any, that may be advantageous to the participant;

Informed Consent: The Document (2) 5. A statement describing the extent, if any, to which confidentiality of records identifying the participant will be maintained; 6. For research involving more than minimal risk, an explanation as to whether or not any compensation and an explanation as to whether any medical treatments are available if injury occurs and, if so, what they consist of, or where further information may be obtained; 7. An explanation of whom to contact for answers to pertinent questions about the research and research subjects' rights, and whom to contact in the event of a research-related injury to the subject; and 8. A statement that participation is voluntary, refusal to participate will involve no penalty or loss of benefits to which the subject is otherwise entitled, and the subject may discontinue participation at any time without penalty or loss of benefits to which the subject is otherwise entitled.

Informed Consent: The Document (3) Additional elements shall be addressed, as appropriate: (1) A statement that the particular treatment or procedure may involve risks to the subject (or to the embryo or fetus, if the subject is or may become pregnant) which are currently unforeseeable; (2) Anticipated circumstances under which the subject's participation may be terminated by the investigator without regard to the subject's consent; (3) Any additional costs to the subject that may result from participation in the research; (4) The consequences of a subject's decision to withdraw from the research and procedures for orderly termination of participation by the subject; (5) A statement that significant new findings developed during the course of the research which may relate to the subject's willingness to continue participation will be provided to the subject; and (6) The approximate number of subjects involved in the study.

Informed Consent: Vulnerable Populations The informed consent document is tailored to vulnerable populations by the following: * the assent form for minors * the parental permission form * the translated consent form * the use of the short form consent * the use of advanced directives in the consent * the use of Legally Authorized Representatives or surrogates

Informed Consent and the FDA In addition to OHRP requirements, the FDA has additional requirements for research under FDA their purview: * There are specific requirements for emergency research with an exception from informed consent, otherwise the IRB may not waive consent * Clinical trials must be registered on clinicaltrials.gov * The IRB will not allow enrollment to begin (and therefore not release a consent form) if an IND or IDE is required and 30 days have not passed since issuance of the FDA’s IND/IDE letter.

Informed Consent and HIPAA HIPAA imposes additional requirements for subjects regarding privacy of records and disclosure of information. The HIC has a compound authorization template that incorporates HIPAA required language into the informed consent document.
