Amendment 8 Protection Against Excessive Fines, Bail, Punishment Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. This Amendment protects against overzealous and unreasonable treatment of the citizens by the court.

Amendment 9 Guarantee of Unspecified Rights The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people. This Amendment has been interpreted to protect "natural rights" including life, liberty, and the right to pursue happiness including the freedom of choice in the basic decisions of ones life with respect to marriage, divorce, and the education and upbringing of children. In other words, rights not already mentioned are covered here. For example, you have the right to travel.

Is this search legal? 5.) Mr. C. has been in jail for 10 years waiting for his trial to begin. His attorney claims he should be set free. Should he?

6.) The barracks at Camp Smith is overcrowded. Mark’s mother tells his the U.S. Army has ordered her to let soldiers stay in his room. Mark say’s, “No Way.” Can the U.S. Army make them do this? 7.) Barbara is arrested for shoplifting but police fail to tell her she has rights and proceed to question her for 12 hours until they finally force her to confess. Can the confession be used against her? 8.) Julia and her friends have been tried and convicted of putting toilet paper in their teacher’s front yard. They have been sentenced to serve 10 years in prison. They argue that this is not fair. Are they right? 9.) Frank decides to publish on his facebook account a song he recently recorded that insults the president? Is he allowed to do this? 10.) Cindy was recently caught stealing iPods from the girls locker room. After a short trial, Andrea was convicted of her crime and sentenced to life in prison without the chance of parole. Was Cindy’s sentence correct?

11.) After a recent crime wave, Steve decides that it is time to purchase a gun for protection. Not long after the purchase, Steve posts a sign on his front yard that “All Intruders Will be Shot.” Can he do this? 12.) Recently the State Legislature has begun discussing legislation, which would make it illegal for people of Muslim faith to pray at work. Is this allowed? 13.) Recently legislation was passed that made legal for authorities to arbitrarily question persons of Latin-American decent whether they are legal or illegal U.S. citizens. In other words, if you look or sound foreign, you are going to be subjected to never-ending requests for police to confirm your identity and to confirm your citizenship. Is this legal?
