Timber Ridge of Clermont County Homeowners’ Association Proposed Amendments to the Declarations of Covenants and Restrictions

4 Current Covenants: Declaration of Covenants and Restrictions may be amended or terminated by a vote of two-third (2/3) majority of its Members entitled to vote.

5 Proposed New Covenants: XXIV. WHEREAS,... the Declaration of Covenants and Restrictions may be amended or terminated by a vote of two-third (2/3) majority of its Members in good standing who voted.

6 Proposed New Covenants: II. For a member to be considered “in good standing” their dues must be current and there can be no outstanding violations or HOA assessed liens on the property.

7 Current Covenants: II. Each lot owned will entitle its owner or owners, collectively, to a single vote.

8 Proposed New Covenants: III. Each lot owned will entitle its owner or owners, collectively, who are in good standing, to a single vote. When an individual or corporation in good standing owns more than one lot, they are entitled to only one vote for their combined ownership.

9 Proposed New Covenants: VI. Unless an extension is granted by the Trustees, any exterior construction shall be fully completed and all unused construction materials shall be removed within a period of six months from beginning construction.

10 Current Covenants: VI. Swimming pools shall be installed below ground level and shall be located only in the rear yard.

11 Proposed New Covenants: VII. Permanently installed swimming pools shall be installed below ground. All seasonal (temporary above ground) swimming pools shall be assembled no earlier than May 15th and disassembled no later than September 15th. All swimming pools shall be located in the rear yard only.

12 Current Covenants: VI. No commercial or educational business or enterprise shall be conducted within the Subdivision nor shall any sign, display or advertising be permitted with the exception of one (1) standard real estate "For Sale" signs no larger than thirty (30") inches square.

13 Proposed New Covenants: VII. Any commercial, educational, or business enterprise conducted within the subdivision shall be conducted according to the Goshen Township, Ohio Zoning Requirements.

14 Proposed New Covenants: X. As to all other signs, each dwelling is permitted to display two signs.

15 Proposed New Covenants: XI. All fences shall be a split rail, Kentucky Board, wrought iron, or picket design and made of wood, iron, or vinyl.

18 Proposed New Covenants: XVI. Any type of temporary storage container used during moving or construction shall only be on the homeowner's concrete driveway or concrete apron while in the subdivision, and removed within six months.

20 Proposed New C.O.R.: 3.2 When an individual or corporation owns more than one lot, they are entitled to only one vote for their combined ownership.

21 Proposed New C.O.R.: 3.3 The annual dues payable to the Timber Ridge of Clermont County Homeowners’ Association by a member will be in the amount of $ per year, per lot, payable January I, of each year, subject to amendment by the Trustees.

22 Proposed New C.O.R.: 5.3 The president is the chief executive officer of this Corporation and will, subject to the control of The Trustees or any Committees, supervise and control the affairs of the Corporation. The president will perform all duties incident to the office and any other duties that may be required by these Regulations or prescribed by The Trustees.

23 Current C.O.R.: 8.01 The authority to alter, amend or repeal all regulations and by laws or to adopt new regulations and by laws to the extent allowed by law, is vested in the acting Homeowners Association Board, except as otherwise provided.

24 Proposed New C.O.R.: 8.1 The authority to alter, amend, or repeal all regulations and bylaws or to adopt new regulations and bylaws to the extent allowed by law is vested in the homeowners. Proposals to make any modifications must be brought to The Trustees, but must be held until the annual meeting. At that time, the proposed modification will be brought to a vote by the homeowners in which all voting rules will apply.

25 Proposed New C.O.R.: Article IX Resolution of Fines Step 1: Letter sent by first class mail Step 2: If no correction is taken within 14 days, a certified letter will be sent and $10 daily fines begin Step 3: After 90 days, a lien will be filed
