Chase Sports Rental Agreement Indemnification: For good and valuable consideration, the receipt and sufficiently of which are hereby acknowledged. Renter hereby expressly agrees to indemnify and hold harmless Chase Sports Specialist, LLC, all Company agents, servants, successors, heirs, executors, administrators and personal representatives against all suits, actions, claims, demands or damages that arise out of Renter’s use, misuse or abuse of said rented Baseball and/or Softball equipment noted herein. Renter’s Initials__________________ Terms and Conditions: 1. Assumption of Risk: Renter acknowledges that the activities for which the rented baseball/softball equipment is designed include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of the baseball/softball equipment. Renter’s Initials__________________________ 2. Acceptable Use: Renter agrees and acknowledges that he/she will be the sole operator of the baseball/softball equipment and will use the equipment is a careful, safe and conscientious manner. Renter shall at all times observe and adhere to any rules and guidelines posted by Chase Sports Specialist, LLC and any applicable laws or regulations. Renter shall be responsible at all times for the safe of any and all persons involved in the use of the equipment. Renter’s Initials__________________________ 3. Use of Equipment: Renter has been shown how to fully operate equipment and all questions regarding operation have been answered. Renter’s Initials__________________________ 4. Prohibited Activities: Renter shall not violate any of the following rules and regulations during his/her operation of rented equipment: –Equipment is not to be use in rainy weather. –Equipment is not to be used during a lightning storm. –Renter will not be refunded his/her security deposit if any of the Prohibited Activities occur. –Renter’s Initials________________________________

Chase Sports Rental Agreement 5. Unsafe Use: If at any time Chase Sports Specialist, LLC determines that the Renter has engaged in an unsafe or hazardous use of the rented baseball/softball equipment, the Company may stop and recall any further use of rented equipment, and immediately terminate the rental. Upon termination, renter must return the equipment to the designed pick up area. Renter will not be refunded his/her rental fees, and the Company shall determine in its sole discretion whether any behavior or activity is ‘unsafe or hazardous’. Renter’s Initials___________________ 6. Condition of Equipment Upon Return: The Renter shall return the equipment at the designated time and place, clean and in the same condition as it was when given to the Renter, except ordinary wear and tear. Renter shall be responsible for any damage caused to the equipment during the rental period. Company shall retain any portion (or all) of Renter’s security deposit as necessary to cover repairs for such damages. (A price sheet is provided at the time of rental for all part costs.) To the extent that damages to the equipment exceed the amount of the security deposit Renter shall be billed by Company for the full amount of damages caused by Renter during the rental period, including reasonable attorney’s fees. Late Return: If Renter returns the equipment to the designated pick up area more than 1 hour after the predetermined “Time In”, Renter shall be charge a late fee per hour past the “Time In”. Renter’s Initials___________________ 8. Inclement Weather: Chase Sports Specialist, LLC will not refund because of inclement weather in which equipment cannot be used. Renter’s Initials___________________ 9. New Machine Purchase Offer: Renter has 72 hours from date of equipment return to purchase a brand new pitching machine and 50% of the rental cost paid will be applied to the purchase price of the new machine. **There is a $50.00 cancellation fee for any rental agreement cancelled**
