NJSBGA APPROVED TRAINING  OSHA created the Hazard Communication Standard to help ensure worker safety when working with hazardous chemicals.  In 2012 OSHA revised the HazCom Standard to be consistent with the Globally Harmonized System (GHS)

NJSBGA APPROVED TRAINING  As you can see, by the end of this school year, you will be seeing Labeling and Safety Data Sheets in your buildings that will be in compliance with the new Law.

NJSBGA APPROVED TRAINING  Will have changes to;  Hazard Classification’s  Labels  Pictograms  Safety Data Sheets (formally MSDS)  Information and Training Globally Harmonized System AKA - GHS

NJSBGA APPROVED TRAINING  Hazard Classification:  Provides specific criteria for classification of health and physical hazards, as well as classification of mixtures  Signal Words include;

NJSBGA APPROVED TRAINING  Labels:  Chemical manufacturers and importers will be required to provide a label that includes a harmonized signal word, pictogram, and hazard statement for each hazard class and category.  Precautionary statements must also be provided.

NJSBGA APPROVED TRAINING  Safety Data Sheets:  Will now have a specified 16-section format  The 16 Section format is basically the ANSI Format  The OSHA Format was only 8 Sections and previously was the MINIMUM REQUIRED INFO.  Sections Are not enforced by OSHA but are still important.  These discuss Aquatic toxicity, Soil resilience and other topics governed by different agencies.

NJSBGA APPROVED TRAINING  At this time, NJ PEOSH HAS NOT adopted the GHS as Law.  OSHA has made Education and Training mandatory for PRIVATE employees ONLY.

NJSBGA APPROVED TRAINING  Even though NJ has not adopted the GHS, you will start seeing products that will have labels and Safety Data Sheets that will be in compliance with the Law.

NJSBGA APPROVED TRAINING  You will now have the knowledge of what the GHS dictates and be able to understand the new Law and be in a better position to protect yourself and occupants of your school building.

NJSBGA APPROVED TRAINING  Information and Training:  The GHS does not address training.  However, the proposed HCS will require that workers are trained within two years of the publication of the final rule to facilitate recognition and understanding of the new labels and safety data sheets.

NJSBGA APPROVED TRAINING A single word used to indicate the relative level of severity of hazard and alert the reader to a potential hazard on the label.

NJSBGA APPROVED TRAINING The signal words used are “Danger" and “Warning." "Danger" is used for the more severe hazards, while “Warning" is used for less severe hazards.

NJSBGA APPROVED TRAINING A symbol plus other graphic elements, such as a border, background pattern, or color that is intended to convey specific information about the hazards of a chemical.

NJSBGA APPROVED TRAINING Each pictogram consists of a different symbol on a white background within a red square frame set on a point (i.e., a red diamond).

NJSBGA APPROVED TRAINING Employers Must:  Provide a Hazard Communication Program  Label Containers in accordance with NJRTK  Maintain SDSs  Train on Hazardous Materials

NJSBGA APPROVED TRAINING Employees Must:  Read labels and SDSs  Follow Employer Instructions & Warnings  Identify Hazards Before Starting a Job  Use Appropriate Safety Procedures and Equipment  Participate in Training

NJSBGA APPROVED TRAINING  The Act Section 34:6A-33 states:  “Every employer shall provide each of his employees with employment and a place of employment which are free from recognized hazards which may cause serious injury, physical harm or death to his employees”.

NJSBGA APPROVED TRAINING  N.J.S.A. 34:6A-34 states:  “Each employee shall comply with occupational safety and health standards and all regulations promulgated under this Act which are applicable to his own actions and conduct.”  The Act does not provide for the issuance of citations or the proposal of penalties against employees.  Employers are responsible for employee compliance with the standards.

NJSBGA APPROVED TRAINING  The CSHO is expected to obtain information to ascertain whether the employer is exercising appropriate oversight of the workplace to ensure compliance with the Act.  Concerted refusals by employees to comply will not ordinarily bar the issuance of a citation where the employer has failed to exercise its authority to adequately supervise employees, including taking appropriate disciplinary action.

NJSBGA APPROVED TRAINING  “Serious” violation means a hazard, violation or condition evidencing a substantial probability that death of serious physical harm could result.

NJSBGA APPROVED TRAINING  Illnesses that constitute serious physical harm include, but are not limited, to:  Cancer;  Respiratory illnesses (silicosis, asbestosis);  Hearing impairment;  Central nervous system impairment;  Visual impairment; and  Poisoning.

NJSBGA APPROVED TRAINING  N.J.S.A 34:6A-41 provides the Commissioner of Labor with the statutory authority to propose civil penalties for violations of the Act.  Civil penalties advance the purposes of the Act by encouraging compliance and deterring violations.

NJSBGA APPROVED TRAINING  Penalty amounts PEOSH issues with citation(s).  N.J.S.A 34:6A-41(d) provides the following: 1. If the time for compliance with an order of the Commissioner lapses, and the employer has not made a good faith to comply, a civil administrative penalty of up to $7,000 per day for each violation shall be imposed 2. Any employer who willfully, or repeatedly violates the requirements of this section or any standard, rule, order or regulation promulgated under the Act shall be assessed a civil administrative penalty of up to $70,000 for each violation, 3. If the violation is of a continuing nature, each day during which it continues after the date given for compliance in accordance with the order of the commissioner shall constitute an additional separate and distinct offense.

NJSBGA APPROVED TRAINING  Chemical Containers Require Labels  Most Products Come in with appropriate Labels and Information.  Unlabeled Containers Must be Rejected and not Used or Opened.

NJSBGA APPROVED TRAINING Every container at an employer’s facility shall bear a label indicating the chemical name and CAS number of all hazardous substances in the container, and all other substances which are among the 5 most predominant substances in the container, or the Trade Secret Registry Number assigned to the substance. This is commonly referred to as “Universal Labeling.” Labels shall be affixed to containers before containers are opened or within 5 working days of the containers arrival at the facility, whichever is sooner.
