Assault Violent Crimes Definitions As found in the New York State Penal Codes

ASSAULT 1. Aggravated Assault – attack or attempted attack with a weapon whether or not injury occurs or without a weapon but serious injury occurs 2. Simple Assault – attack without a weapon with injuries requiring less than two days hospitalization. 3. Battery – attack by person to person that results in striking or touching the victim (battery is not recognized in New York State).

Assault and Abuse in the American Family Spousal Abuse: Assault against one’s own spouse – husband or wife. Seventy percent are listed as simple assault instead of aggravated assault with serious injury.
