Is the State of Iowa a Class Member?  Only Class Members are entitled to settlement benefits.

The State of Iowa is a Class Member if it:

 Indirectly purchased any of the following products from July 1, 2002 through and including June 30, 2006, for use in Iowa and not for resale:

The State of Iowa is a Class Member if it purchased:  Microsoft Windows (including Windows for Workgroups, Windows NT Workstation)  MS DOS  Office  Excel  Word (including Home Essentials 97 or 98 and Works Suite)  The State of Iowa may submit a claim for each license of these software products that it purchased from July 1, 2002 through and including June 30, 2006.

 Pointer: The eligible software product may have been purchased standing alone or preinstalled on a computer.  Pointer: Purchases of software for server computers or Apple computers are not eligible.

How to Make a Claim For Settlement Benefits

All Class Members must file a Claim Form in order to receive Settlement benefits.

All Claim Forms Must be Postmarked on or before December 14, 2007.

Which Claim Form?  Volume License Claim Form (press 9)  Iowa State and Local Government Claim Form

Is the State of Iowa a Volume Licensee?  Many governmental entities purchased Microsoft licenses under Microsoft’s “Open,” “Select,” or “Enterprise” license programs.

How to File a Volume License Claim Form  If the State of Iowa purchased any eligible Microsoft products under a “Open,” “Select,” or “Enterprise” license program, it should complete a VOLUME LICENSE CLAIM FORM.

Volume License Claim Form  To help ensure that all future correspondence from the Claims Administrator is received and acted upon by the appropriate person at the State of Iowa, identify a “settlement benefits coordinator.”

Volume License Claim Form: Part B  Part B: “Eligible Products Acquired Through A Microsoft Volume License” Check the box in Part B. Check the box in Part B.

Volume License Claim Form: Part B  By checking the box in Part B, you are requesting that the Claims Administrator search Microsoft’s records for the State of Iowa’s volume license purchases.  You will receive a report listing all of the State of Iowa’s volume license purchases of eligible Microsoft products from July 1, 2002 through and including June 30, 2006 according to Microsoft’s records.

Volume License Claim Form: Part B  You will have 90 days to make corrections and/or additions to the State of Iowa’s report (including adding claims for purchases made outside the State of Iowa’s volume license agreements).  The State of Iowa’s claim will be automatically approved for any eligible volume license purchases that appear in Microsoft’s records.

Volume License Claim Form: Part B  Pointer: For Open and Select volume license agreements, each upgrade counts as a separate claim.  Pointer: For Enterprise volume license agreements, only the initial license purchased under the agreement qualifies. Claims for automatic upgrades are not valid.

Volume License Claim Form: Part B  In some instances, a volume license agreement may permit sub-entities to purchase products through it.  To assist the Claims Administrator’s search of Microsoft’s records, provide a list of any additional entities that may have purchased eligible products or have a separate license agreement. (example: Dental Examiner’s Board or Iowa State Lottery)

Volume License Claim Form: Part C  Many volume licensees also purchased licenses for Microsoft products outside of its license agreement.  Make claims for those products in Part C.

Volume License Claim Form: Part C  Claims in Part C require proof of purchase.  Many types of proof of purchase will satisfy this requirement (invoices, receipts, Product Key numbers, Product ID numbers, CD Key numbers, Certificates of Authenticity, etc)

Volume License Claim Form: Part C  Pointer: The settlement website contains information on how to locate Product Key numbers, Product ID numbers, CD Key numbers, Certificates of Authenticity.  Pointer: In some instances, vendors will supply you with a buying history.  Pointer: Every copy of Office comes with Word and Excel. The purchase of a license for Office should be claimed as one Office license and not claimed as a license for Office, Word and Excel.

Volume License Claim Form: Part F  Voucher redemption can be done at the time the State of Iowa submits its claim if it has purchased qualifying hardware or software after April 25,  Part F needs to be completed only if the State of Iowa is seeking to claim all or a portion of its settlement benefits now.

Volume License Claim Form: Part F  If the State of Iowa submits proof of purchase of qualifying hardware or software purchased after April 25, 2007, payment will be sent without first requiring the State of Iowa to receive and redeem a voucher.

Vouchers Can Be Redeemed For:  Any desktop, laptop or tablet computers made by any manufacturer for any operating system.  Any of the following devices: printers, scanners, monitors, keyboards, or pointing devices.  Any non-custom software offered by any software vendor for use on a desktop, laptop or tablet computer.  The qualifying hardware or software does not have to be a Microsoft product.

Volume License Claim Form: Part F  Proof of Purchase of qualifying hardware or software includes: receipt receipt Packing slip Packing slip Invoice Invoice Other documentation showing the purchase of qualifying hardware or software Other documentation showing the purchase of qualifying hardware or software

If the State of Iowa Is Not a Volume Licensee  The State of Iowa may have obtained its eligible Microsoft products by purchasing them only at a store, by mail or the Internet, or by purchasing a computer with the software already installed.  If the State of Iowa did not purchase any eligible Microsoft products under a “Open,” “Select,” or “Enterprise” license program, use a IOWA STATE AND LOCAL GOVERNMENT CLAIM FORM.

Voucher Redemption Process  Vouchers can be redeemed for cash by submitting proof of the State of Iowa’s purchase of qualifying products to the Claims Administrator.  This redemption can be done at the time the State of Iowa submits its (1) Claim Form; or (2) its Voucher.  If the State of Iowa does not redeem the total value of its vouchers in its first redemption, a new voucher will be issued for the remaining value.
