What crimes must be reported under the Clery Act? Who must report? How do you report a crime under the Clery Act? What happens to the information reported?

On Campus On property owned or controlled by the University. On public property within or adjacent to University property.

Criminal Homicide Negligent Manslaughter Sex Offenses Robbery Aggravated Assault Burglary Motor Vehicle Theft Arson ND also voluntarily reports Larceny

All the Criminal Offenses that are Clery Reportable. Any crime involving bodily injury. Larceny/Theft Simple Assault Intimidation Destruction, damage, vandalism of property When the crime is motivated by prejudice/bias based on race, gender, religion, sexual orientation, ethnic/national origin, or disability.

Weapons Possession Drug Violations Liquor Law Violations

NDSP collects, maintains, publishes Clery information. Campus Security Authorities must report to NDSP.

A member of a campus police/security department. Any individual or individuals who have responsibility for campus security but who do not constitute a campus police/security department (e.g., an individual who is responsible for monitoring the entrance into institutional property). Any individual or organization specified in an institution’s statement of campus security policy as an individual or organization to which students and employees should report criminal offenses.

An official of an institution who has significant responsibility for student and campus activities, including but not limited to, student housing, student discipline and campus judicial proceedings. An official is defined as any person who has the authority and duty to take action or respond to particular issues on behalf of the institution. Examples: Deans, Directors, Student Activities Office, Coaches, Club Advisors, ORLH, R.A.s, A.R.s, etc. Exempt: Pastoral counselors, professional counselors while functioning within the scope of that recognition/license/certification.

What must be reported? The Clery reportable crimes previously discussed that have NOT been reported to NDSP. How do we report? Complete Reporting Forms and Submit to NDSP Director. Contact the Director of NDSP. When do we report? As soon as you become aware of the crime. WHEN IN DOUBT, REPORT!

An ND student forcibly rapes another ND student at a party in a house one block from campus rented by ND students. Not Reportable A student’s laptop is stolen from his/her room in a residence hall. Reportable Two people (not at all affiliated with the University) tailgating in the C1 Parking Lot on Gameday get in a fight. One of the tailgaters ends up needing stitches. Reportable A protester at Notre Dame Avenue and Angela is intentionally run down by a vehicle travelling westbound on Angela as the protester crosses the street heading away from campus. Reportable A home on the north side of Angela adjacent to the Burke Golf Course that is rented and occupied by students is burglarized. Not Reportable

Reviewed and included in statistics if applicable. May result in a Timely Warning/Crime Alert. Will generally NOT result in a police report or be investigated by the police.

The U.S. Department of Education enforces the Clery Act The Department of Education can issue fines up to $27,500 per violation for a substantial misrepresentation of number, location or nature of crimes required to be reported. Non-compliance makes the institution looks like it’s trying to hide something. Prevents community members or perspective community members from making informed decisions that impact their safety.

Any official of an institution who has significant responsibility for student and campus activities is considered a “Campus Security Authority” under the Clery Act. Campus Security Authorities must report Clery Reportable Crimes that they are aware of to NDSP for inclusion in campus crime statistics and for “Timely Warnings” when applicable. When in doubt, Report!
