10 OSK Trustees – Why Do You Need A Will? 4) Free Your Loved Ones From Long & Tedious Legal Process and Possible Disputes 4.1Avoid the problem associated with choosing an Administrator All lawful beneficiaries of your estate must unanimously consent to the choice of an Administrator that they trust Problem – this may not be possible and causes delay as there may be a disagreement amongst the lawful beneficiaries and difficulty in locating all the beneficiaries to consent. 4.2Avoid the legal requirement of 2 sureties The Administrator chosen would have to provide 2 sureties in the application for Letters of Administration. The 2 sureties are to provide a guarantee for the lawful beneficiaries based on the gross value of the estate. Problem – on demise of a wealthy person, it would be difficult to find a person with wealth equivalent to the estate to be a surety and even if found, such person may not want to be a surety.
