Staff Report Public Interaction Next Steps Conclusion

Only.10 miles of Riddle Cove part of Town Street Maintenance Program (4.93 mi) None of Creekside Drive within the Town Street Maintenance Program 103 Town properties are accessed by this system ~ 50 County properties are accessed by this system 3 Distinct Neighborhoods are accessed by this system Creekside Villas Horseshoe Cove Country Club Cove Estates

No Unified Road Maintenance Program No Maintenance = Poor Road Health Pavement “End of Life” Town Staff have received numerous calls within the last year for road assistance Town Staff have met with neighborhood activists who have varying ideas and plans on how to address road failure

Pot Holes Pavement Failure Ditch Failure Lack of Ditch Maintenance High Levels of Sedimentation

Temporary Seasonal Solution Ditch Maintenance, Gravel Addition Effected Area Special Assessment Non Powell Bill Street Assistance Status Quo

The Town of Maggie Valley Board of Aldermen is very much aware of the current road conditions of Riddle Cove Road and Creekside Drive The Board of Aldermen has authorized Town Staff to aid the greater community concerning this issue; ideally drafting a formal proposal for their review The Board of Aldermen must approve whatever draft solution staff and the community create.

Any city is authorized to make special assessments against benefited property within its corporate limits for: (1) Constructing, reconstructing, paving, widening, installing curbs and gutters, and otherwise building and improving streets; (2) Constructing, reconstructing, paving, widening, and otherwise building or improving sidewalks in any public street; (3) Constructing, reconstructing, extending, and otherwise building or improving water systems; (4) Constructing, reconstructing, extending, or otherwise building or improving sewage collection and disposal systems of all types, including septic tank systems or other on ‑ site collection or disposal facilities or systems; (5) Constructing, reconstructing, extending, and otherwise building or improving storm sewer and drainage systems

(a) A city shall have no power to levy special assessments for street or sidewalk improvements unless it receives a petition for the improvements signed by at least a majority in number of the owners of property to be assessed, who must represent at least a majority of all the lineal feet of frontage of the lands abutting on the street or portion thereof to be improved. Unless the petition specifies another percentage, not more than fifty percent (50%) of the cost of the improvement may be assessed (not including the cost of improvements made at street intersections).

Assessments may be made on the basis of: (1) The frontage abutting on the project, at an equal rate per foot of frontage, or (2) The area of land served, or subject to being served, by the project, at an equal rate per unit of area, or (3) The value added to the land served by the project, or subject to being served by it, being the difference between the appraised value of the land without improvements as shown on the tax records of the county, and the appraised value of the land with improvements according to the appraisal standards and rules adopted by the county at its last revaluation, at an equal rate per dollar of value added; or (4) The number of lots served, or subject to being served, where the project involves extension of an existing system to a residential or commercial subdivision, at an equal rate per lot; or (5) A combination of two or more of these bases.

Intersection of Ivy & Riddle Cove Road to the Intersection of Paso Fino & Stallion Ridge

Repair all pavement surface deficiencies Widen road to average of 16 feet Improve drainage system Would add 0.8 miles of publicly maintained road Current Town System 4.93 mi ELIMINATES NEED FOR PRIVATE MAINTAINECE

$283,500 total cost $85,050 (Town Share, 30% Total Cost) Largest ever Town of Maggie Valley Road Expenditure $198,450 (Special Assessment Cost) 103 Total Lots $1927 per lot commitment $642 (3yr)$385 (5yr)

$187,500 cost $56,250 (Town Share, 30% Total Cost) $131,250 (Special Assessment Cost) 103 Total Lots $1274 per lot commitment $425 (3yr)$255 (5yr)

$135,000 cost $40,500 (Town Share, 30% Total Cost) $94,500 (Special Assessment Cost) 103 Total Lots $917per lot commitment $306 (3yr)$183 (5yr)

Can only be applied to Publicly Maintained Roads All roads being discussed are Privately Maintained Roads Town of Maggie Valley need these to be dedicated to the Town take improvement actions Town of Maggie Valley can only accept roads if there is a guarantee from the property owners The guarantee the Town is requiring commitment to the Special Assessment Commitment Forms will be available after the meeting

Requires neighborhood to request funds by May 1, 2012 Competitive with other neighborhoods and projects Board of Aldermen select which projects get funded using the following criteria projects meeting construction & design standards can receive up to 30% total cost Projects meeting only construction can receive up to 15% of total cost

Not intended for large projects, due to the large amount of upfront capital needed for local match Works much better within the confines of one subdivision, more clearly define roles, demands and expectations Riddle Cove/Creekside have three district groups, with differing levels of organizational strength

Road will continue to erode into disrepair Accelerated loss of shoulder and pavement have been witnessed within last year Hope that the homeowners unify to find a solution without Town assistance

Tim Barth, Town Manager Nathan Clark, Planning Director x104 Mike Mehaffey, Public Works Director

16 of the 25 property owners in attendance believed the Staff Recommended Option was the best option to pursue Option will be presented at the November 13 Board of Aldermen Meeting Dedication & Assessment vote letters will be mailed to all affected property owners after the November 13 meeting If a majority of affected property owners sign “yes” to dedication/assessment road improvements should be completed by May 2013
