City of Modesto FY Proposed Budget City Attorney Department  City Attorney Department Overview The City Attorney provides the following services to the community:  Represents the City, its Council, boards and commissions in all actions or proceedings in which they are concerned or a party.  Represents City officers and employees in all actions or proceedings in which they are a party-defendant due to the performance of their official duties.  Advises the Council and all City officers in all matters of law pertaining to their offices.  Provides legal advise or opinion on the legality of all matters under consideration by the Council, or by any of the boards, commissions or officers of the City.  Prosecutes on behalf of the people all criminal cases for violations of City ordinances, City Charter and other City laws.  Approve as to form all ordinances, resolutions and contract documents before presentation to Council.  Enforce the City’s Policies against harassment, discrimination and retaliation pursuant to Title VII of the Civil Rights Act of  Conduct any and all investigations into allegations of harassment, discrimination and retaliation, including charges filed with the Equal Opportunity Commission and or Department of Fair Employment and Housing. City of Modesto FY Proposed Budget Achievements in : Despite a reduction in staff attorneys, the City Attorney’s Office has continued to handle a majority of the City’s legal matters in-house in an effort to minimize the costs to the City. The City Attorney’s Office has continued to diligently defend the City in numerous litigation cases, vigorously pursuing resolutions that serve the City’s best legal interest. We have successfully defended the City on significant Civil Rights Liability Cases with favorable outcomes, in addition to continuing to provide significant legal support for all City departments. In addition, we have successfully implemented the following in order to increase legal awareness and experience within the community: City Attorney’s Legal Awareness Program City Attorney’s Office/Modesto Junior College Internship Program City Attorney’s Law Clerk Internship Program FY Proposed Budget City Attorney Department

City of Modesto FY Proposed Budget EQUAL OPPORTUNITY ENFORCEMENT –Involving allegations of harassment, discrimination & retaliation The City Attorney’s Office prepared a stand alone Non-Retaliation Policy, in addition to the City’s Harassment and Discrimination Policy, in order to further protect individuals engaged in a protected activity from being subjected to retaliatory conduct. That Policy was adopted by the City Council on March 27, The following is a breakdown of the number of complaints (22) filed in FY from City employees: FY Proposed Budget City Attorney Department
