47 What’s New Overview of Rule 9B Rational engineering analysis cannot be used in lieu of a standardized test required by the Code for approval of products within the scope of standards. A legacy evaluation report from a nationally recognized model code organization may be used if it shows compliance with the Code. Evaluation Report and Test Report Requirements. When the Code requires a standardized test … the test lab must be accredited by an approved accreditation body for the test performed. The entity issuing the evaluation report or certification is responsible to ensure that the test lab is accredited. Complete Description including all drawings, manufacturer’s product designation & materials except materials specifics identified as proprietary. Installation Instructions including attachments shall be developed by an evaluation entity, test lab or the manufacturer’s licensed design professional. Prior to posting installation instructions, including anchorage requirements, on the BCIS, they shall be reviewed or verified by the evaluation entity, test lab architect or engineer of record by the manufacturer’s licensed design professional.

49 What’s New Overview of Rule 9B Revisions to all data will be allowed Original approval will remain in effect while the revision approval is being processed. Approved revisions will be noted on the BCIS by an R1, R2, etc. following the original FL number. Example FL1234 revised the first time will be noted as FL1234- R1.

51 What’s New Overview of Rule 9B Incomplete Product Approval or Entity Applications. Any Application that has no activity or is not complete within 180 days from the date of initial filing shall be revoked.
52 What’s New Overview of SB 442 Local Product Approval (S. 19) Product or systems of construction must demonstrate compliance with the structural windload requirements of the Florida Building Code through one of the following methods: (a) A certification mark, listing, or label from a commission-approved certification agency indicting that the product complies with the Code. (b) A test report from a commission-approved testing lab indicating that the product tested complies with the Code. (c) A product-evaluation report from a commission-approved product evaluation entity indicating that the product complies with the Code. (d) A product-evaluation report from a Florida professional engineer or Florida registered architect indicting that the product complies with the Code. (e) A statewide product approval issued by the Florida Building Commission.
53 What’s New Overview of SB 442 Local Product Approval (S. 19) Certification of independence from the product manufacturer is required for the following methods: test report and evaluation reports. Products demonstrating compliance shall be manufactured under a QA program audited by an approved QA entity. Products bearing a certification mark or listing or label by an approved certification agency require no further documentation to establish compliance.
54 What’s New Overview of SB 442 Local Product Approval (S. 19) Local building officials may accept modifications to products or their installations provided sufficient evidence is submitted to the local building official to demonstrate compliance with the Code or the intent of the Code, including such evidence as certifications from a Florida Registered Architect or Florida Professional Engineer. Upon review of the compliance documentation, and a finding that the product complies with the Code, the authority having jurisdiction or a local building official must deem the product approved for use in accordance with its approval and limitation of use.
55 What’s New Overview of SB 442 Local Product Approval (S. 19) Approval must be valid until such time as the product changes and decreases in performance; the standards of the code change, requiring increased performance; or the approval is other-wise suspended or revoked. Change to the code do not void the approval of products previously installed in existing buildings if such products met building code. Eliminate the mandatory check list required for local product approval. Eliminate the application form and use the criteria currently in the form as a list of minimum criteria required for product approval.
