RFP PROCESSES Contracts for Professional Services

RFP Requirements No agency of the state may award or renew a contract for professional services exceeding fifty thousand dollars without complying with the procedures set forth in this Act. Any agency seeking such professional services shall issue a request for proposals. The agency shall publish any request for proposals issued pursuant to this section on the electronic procurement system maintained by the Bureau of Administration. The request for proposals shall include the procedures for the solicitation and award of the contract.

RFP Requirements The request for proposals shall state the relative importance of evaluation criteria to be used in the ranking of prospective contractors. The agency shall include the following evaluation criteria in any request for proposals:

RFP Requirements Specialized expertise, capabilities, and technical competence as demonstrated by the proposed approach and methodology to meet the project requirements; Resources available to perform the work, including any specialized services, within the specified time limits for the project; Record of past performance, including price and cost data from previous projects, quality of work, ability to meet schedules, cost control, and contract administration; Availability to the project locale; Familiarity with the project locale; Proposed project management techniques; and Ability and proven history in handling special project constraints.

NEGOTIATIONS The agency and the highest ranked contractor shall mutually discuss and refine the scope of services for the project and shall negotiate terms, including compensation and performance schedule. The compensation level paid shall be reasonable and fair to the agency, as determined by the agency.

NEGOTIATIONS If the agency and the highest ranked contractor are unable for any reason to negotiate a contract at a compensation level that is reasonable and fair to the agency, the agency shall, either orally or in writing, terminate negotiations with the contractor. The agency may then negotiate with the next highest ranked contractor.

NEGOTIATIONS The negotiation process may continue through successive contractors, according to agency ranking, until an agreement is reached or the agency terminates the contracting process.

PUBLIC INFORMATION A register of proposals shall be prepared and maintained by any state agency issuing a request for proposals for a professional service contract. The register shall contain the names of any person/company whose qualifications were considered and the name of the person/firm that was awarded the contract. Any professional service contract and the documentation which was the basis for the contract shall be public except for proprietary information which shall remain confidential. The qualifications and any other documentation of any person/firm not issued a contract shall remain confidential.

PROCUREMENT MANAGEMENT ROLE The law DOES NOT REQUIRE agencies to use OPM staff or services to complete their RFP processes. OPM will provide assistance to agencies upon request. OPM will establish an hourly rate that will be charged to the agency requesting assistance with their RFP process. The fee is expected to be $45 per hour.

PROCUREMENT MANAGEMENT ROLE Some services available to agencies from OPM Assistance in preparing RFP in proper format. Review agency RFP language and make recommendations. Provide guidance on steps to be taken throughout the process. Coordinate the entire RFP process if requested. Debrief unsuccessful offerors based on the evaluation team report(s), but only if OPM is coordinating the entire process. Train agencies on posting RFPs to the eprocurement system, or post RFPs for the agency upon request.

PROCUREMENT MANAGEMENT ROLE Some things OPM will NOT do: Decide whether or not the service you are requesting is a “professional service” or whether the service is exempt from the statute. Prepare a scope of work for the requesting agency. Determine the evaluation criteria to be used by the agency Participate as an active evaluation or negotiation team member.
