Public Meeting of the Fair Lawn Board of Education April 24, 2014 HIB Investigations and Incidents-Report-September 1, December 31, 2013 Electronic Violence and Vandalism Report System-September 1, December 31, 2013 Comments by Superintendent-Superintendent and Board Secretary’s Agenda

 Means: Any gesture, any written, verbal or physical act, or any electronic communication, whether it be a single incident or a series of incidents, that is reasonably perceived as being motivated either by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability, or by any other distinguishing characteristic, that takes place on school property, at any school-sponsored function, on a school bus, or off school grounds as provided for in section 16 of P.L.2010, c.122 (C.18A: ), that substantially disrupts or interferes with the orderly operation of the school or the rights of other students and that: Harassment, Intimidation or Bullying

 A reasonable person should know, under the circumstances, will have the effect of physically or emotionally harming a student or damaging the student’s property, or placing a student in reasonable fear of physical or emotional harm to his person or damage to his property; A.

 Has the effect of insulting or demeaning any student or group of students; or B.

 Creates a hostile educational environment for the student by interfering with a student’s education or by severely or pervasively causing physical or emotional harm to the student. C.

Incident reported to Principal- on/off school grounds, school bus, school event -Complaint investigation initiated within 1 school day of verbal report of incident If HIB-gives to Specialist and Principal requests claimant or witness to put in writing within 2 school days Principal determines code of conduct and/or HIB If code of conduct- Principal determines action/discipline contacts parents/ guardians If HIB-Principal contacts parents, guardians-confirms with Fair Lawn letter/ Form: O1-T1 Specialist begins investigation— completes within 10 school days- Report can be amended after the 10 days. Specialist submits findings/conclusion to Principal in report form Principal completes and attaches summary of incident—assigns Log number-submits packet to Supt. within 2 school days of Specialist’s report completion Supt. Reviews report-logs-agrees/disagrees /modifications and returns to Principal-logs- Principal copies Specialist-logs Supt. Reports to BOE at next mtg. Report (letter/ ) sent to parents of Target and Offender within 5 school days following BOE meeting from Principal Form: O2-T2 BOE issues a decision affirming, rejection, or modifying the Supt. decision at the next BOE following receipt of Board Report Parent can request BOE hearing which must be held within 10 school days BOE decision may be appealed to Commissioner within 90 days Parent, guardian, pupil, organization, can appeal to Div. of Civil Rights within 180 days Fair Lawn Public Schools HIB Policy Investigation and Reporting
