Rights of residents As citizens. Resident rights as stated in the Nursing Facility Requirements for Licensure and Medicaid Certification, 40 TAC §19.401 - §19.423.

Role of the nurse aide… In respecting and promoting resident rights and independence: Provide privacy. Maintain confidentiality. Communicate appropriately and allow resident to make decisions when possible. Accommodate individual needs and preferences. Encourage residents to participate in care as much as possible. Provide care and security of residents’ personal possessions. Maintain safety. Report residents’ complaints of grievances and disputes to nurse. Proper use of technical devices. Assist residents to vote. Assist residents to attend and participate in activities within and outside of the facility. Provide care that is free from abuse, neglect and misappropriation of resident property.

Role of the nurse aide… Definitions (from 40 TAC Chapter 94) In protecting residents from abuse, neglect, and misappropriation of resident property: Definitions (from 40 TAC Chapter 94) Abuse—the willful infliction of injury, unreasonable confinement, intimidation or punishment with resulting physical harm, pain, or mental anguish. Neglect – the failure to provide goods and services necessary to avoid physical harm, mental anguish, or mental illness. Misappropriation of Resident Property – the deliberate misplacement, exploitation, or wrongful, temporary or permanent use of a resident’s belongings or money without the resident’s consent.

Role of the nurse aide… In protecting residents from abuse, neglect, and misappropriation of resident property: Avoiding abuse, neglect and/or misappropriation of resident property. Recognizing signs of abuse: Bruising, swelling, pain or other injuries. Sudden changes in resident’s personality or behavior. Fear and anxiety.

Role of the nurse aide… In protecting residents from abuse, neglect, and misappropriation of resident property: Reporting abuse, neglect or misappropriation of resident property: As members of the health team, nurse aides are legally and ethically responsible for reporting actual or suspected abuse, neglect or misappropriation of resident property.
