COHENS VS. VIRGINIA

THE COHENS BROS.  The Cohens Brothers had started a lottery business in Washington D.C and proceed to sale lotteries in Virginia, but by Virginia state law prohibits the selling of lottery tickets in its states.

ISSUE  Cohen thought that he was immune from the state laws because the lottery tickets had been authorized by Congress.

COURT DECISION  The U.S. Supreme Court decided against the Cohens on the inherent rights.  Judge Marshal federal Supreme Court has the right to review any decision involving powers of the federal government.  State laws that oppose the Constitution are void.
