INFRARED SPECTROSCOPY The ethanol molecule has two ends, the hydrogen end and the hydroxide (carbon-oxygen bond) end. NOW HOLD THAT THOUGHT . . . .

In the visual spectrum: We can tell how much fog or smoke is in the air by how much light is blocked from a light source.

BEER-LAMBERT LAW (Provides the theoretical basis for IR breath testing.) Each molecule absorbs infrared light waves in a unique way. Thus, each molecule has its own “infrared fingerprint.” Ethanol molecules absorb infrared light at wavelengths of approximately 3.00, 3.39, 7.25, 9.18, 9.50 and 11.5 microns. No other compound absorbs infrared light at all of these wavelengths exclusively.

In the Infrared spectrum, the hydrogen end and the hydroxide end act like the fog to block the the light – BUT ONLY in the 3.4 uM and 9.4 uM wavelengths, exclusively. 3.4hhhhhhh 9.4hhhhhhhhhhh

BREATH ALCOHOL CONTENT THE DIFFERENCE, OR “MISSING” IR WAVE INTENSITY CAN BE MEASURED AND IS DUE TO THE BREATH ALCOHOL CONTENT

IF they are not the same, by a 5% difference, THEN the instrument will determine a substance other than ethanol, an interferent, is in the sample. The measurements of the 3.4uM and 9.4uM wavelength filters must match or the substance is an interferent.

Intoxilyzer 8000 To perform a test on the Intoxilyzer 8000 an officer must have a valid permit. The first thing he will do is scan his ACCESS card and put in his PIN or manually type in the information if he does not have his ACCESS card. The 8000 will check an internal data base to verify if your permit is valid, if not you will not be able to operate the instrument. It takes about fifteen minutes to delete an operator from the database across the state if he is disqualified for any reason.

BREATH TEST SEQUENCE IF THE SUBJECT BLOWS DURING AN AIR BLANK THE SCREEN WILL DISPLAY AND YOU WILL GET A PRINTOUT STATING IMPROPER SAMPLE

BREATH TEST SEQUENCE IF the subject has substantial mouth alcohol or THE SUBJECT BLOWS A BREATH SAMPLE THAT IS ABOVE THE RANGE OF THE INTOXILYZER, 0.60 THE SCREEN WILL DISPLAY AND YOU WILL GET A PRINTOUT STATING RANGE EXCEEDED

BREATH TEST SEQUENCE IF THE SUBJECT DOESN’T BLOW AN ADEQUATE SAMPLE, STOPS TOO SOON, STARTS AND STOPS, OR BLOWS AND SUCKS THE SCREEN WILL CONTINUE TO PROMPT “PLEASE BLOW” FOR 3 MINUTES AFTER WHICH YOU WILL GET A PRINTOUT STATING DEFICIENT SAMPLE

AMBIENT FAIL (PURGE FAIL) BREATH TEST SEQUENCE IF THE AIR BLANK IS CONTAMINATED THE SCREEN WILL DISPLAY AND YOU WILL GET A PRINTOUT STATING AMBIENT FAIL (PURGE FAIL)

BREATH TEST SEQUENCE IF THE BREATH SAMPLE IS CONTAMINATED OR THE SUBJECT “PUFFS” RAPIDLY THE SCREEN WILL WILL DISPLAY SAMPLE REJECTED THE SCREEN WILL THEN PROMPT “RETRY Y/N” SELECTING Y WILL START A 16 MINUTE DEPRIVATION CLOCK.

BREATH TEST SEQUENCE IF THE BREATH SAMPLES ARE MORE THAN .03 APART, THE TEST IS NOT VALID AND THE INTOXILYZER WILL PROMPT “RETRY Y/N” YOU CAN RETRY UP TO 3 TIMES WITHOUT HAVING TO RE-ENTER THE SUBJECT INFORMATION. THIS IS ANOTHER PROTECTION AGAINST TESTING MOUTH ALCOHOL.

Calibration Check Out of Tolerance BREATH TEST SEQUENCE IF THE CONTROL TEST IS BEYOND THE .01 TOLERANCE THE INTOXILYZER WILL DISPLAY Calibration Check Out of Tolerance THE PRINTOUT WILL SHOW THE RESULTS WITH THE CONTROL TEST RESULT FLAGGED INVALID AND

BREATH TEST SEQUENCE THE INTRUMENT WILL BE DISABLED THE TEST MUST BE ADMINISTERED ON A DIFFERENT INTOXILYZER OR CONDUCT A BLOOD TEST

BREATH TEST SEQUENCE IF THE TESTING SEQUENCE FAILS, ANY PRINTOUT IS EVIDENCE OF WHAT HAPPENED DURING THE TEST. THE SUBJECT SHOULD RECEIVE A COPY A COPY SHOULD GO TO EVERYONE WHO NORMALLY GETS A COPY OF THE THE AFFIDAVIT THE PRINTOUTS ARE SAVED IN THE MEMORY OF THE INSTRUMENT AND ARE IMMEDIATELY UPLOADED TO THE BOARD COMPUTER IN OKLAHOMA CITY. YOU WILL BE ABLE TO GET THEM.

BREATH TEST SEQUENCE IF THE TESTING SEQUENCE COMPLETES SUCCESSFULLY THE OFFICER’S AFFIDAVIT AND NOTICE OF REVOCATION/DISQUALIFICATION IS SAVED THE SAME WAY. THEY ARE NEVER PURGED FROM THE MAIN COMPUTER. YOU WOULD BE ABLE TO GET A PRINTOUT TEN YEARS FROM NOW. (It may cost you.)

The 8000 Intoxilyzer Temporary Driver License

OFFICER’S AFFIDAVIT DISTRIBUTION On the Officer/DPS Affidavit the officer will complete SECTIONS 2, 3 & 4. SECTION 4 does NOT require a notary.

The 8000 Intoxilyzer Log of Tests is the Officer Affidavit

IMPLIED CONSENT CIVIL ACTION NOT CRIMINAL BURDEN OF PROOF How do you know (something) worked poperly? IMPLIED CONSENT CIVIL ACTION NOT CRIMINAL BURDEN OF PROOF Breath Test Operating Procedure – Push the GREEN button and follow the prompts. If an Affidavit prints, the Officer followed the procedure approved by the Board of Test. If a test result appears, it is a valid, state’s test – even if the result is 0.00.

ADMISSIBILITY 47 O.S. sec. 756 A (brutally edited) Upon the trial of any proceeding out of acts committed by any person driving a motor vehicle while under the influence of alcohol, evidence of the alcohol concentration in the breath of the person as shown by analysis of the breath performed in accordance with Sections 752 and 759 of [title 47] IS admissible.

Title 47], to be admissible in evidence under the provisions of this [O.S. Title 47], shall have been administered in accordance with the rules and regulations of the Board.

COMMON RED HERRINGS The breath tube on the I8000 is shorter than the 5000D and the heater may have failed. Something in the sample chamber could increase the reading by blocking the infra-red light. Mouth alcohol was measured in the breath sample.

COMMON RED HERRINGS No one can review the source code. The particulate screen can clog. The driver can affect the test result by hyperventilating. RFI may have affected the result. Another gaseous substance in the breath may raise the result – interferents.
