Criminal Case People v. Walker As the acting prosecutors and defense it is your task to paper screen and potentially pick the jurors for the following trial!

The Case

On the evening of June 16, Ralph Walker was arrested for robbery, a felony. The victim, Mary Gardiner, was confronted by a man wearing dark slacks and a beige jacket while she was on her way home from a political meeting. Threatening to “hurt her real bad,” the man demanded her money and Gardiner turned her wallet over to him. The police found Walker a few blocks away. His clothing matched the description, and Gardiner’s wallet was in his possession. He says he found the wallet on the street. The victim later identified him in a police lineup and said that even though it was dark that night, “I’m sure he’s the guy.”

Scene of the Crime

Robbery is defined as the taking of property from a person against his or her will through violence or threat of violence.

Mary Gardiner is a 60-year-old black woman living on Social Security. She is a member of the Socialist party, and is a volunteer counselor for “Victims for Victims,” which aids victims of violent crime. Ralph Walker is a 35-year-old white salesman, currently unemployed. He has a high school education.

Your Task 1.You and your partner will be assigned either as Defense Attorneys or Prosecuting Attorneys. 2.It is your task to rank and rate the jurors you want on this panel using your “Jury Outline” form. (Select your side’s top 8). 1.Each side will need to select 2 alternate jurors. 2.Each side will need to select 2 jurors they wish to strike from the other side. 3.Then Prosecution and Defense teams will then meet to select the jurors for this trial. 4.The agreed upon jurors will be the jury your team will use for scoring.

Juror #2 Description: 30-year-old black male, two years of college. Occupation: unemployed actor Family: Single Victim of house burglary two years ago—lost $3,000 worth of goods

Juror #3 Occupation: college student Description: 19-year-old Asian-American majoring in electrical engineering, active in campus science and technology club and Asian Students association. Family: Parents own and operate small neighborhood supermarket, which has been robbed twice in the last year. Three younger brothers and sisters.

Juror #4 Occupation: University professor Description: 53-year old white male, PhD, University teacher 24 years, active in the community but recently feels “burnt out” 3 previous times as criminal case juror. Family: Wife is librarian, one son in high school and one daughter in college

Juror #5 Occupation: Construction Worker Description: 41-year-old white male with partial Native American background. Currently on long- term disability, Wants to serve because he’s bored with hanging around the house.” Family: Wife is unemployed; one married son with baby and a daughter in high school

Juror #6 Occupation: Housewife Description: 42-year-old white female. Active member in local chapter MADD After neighbor was killed by a drunk driver. A volunteer in many local charities. Family: Husband owns auto parts store; 3 children

Juror #8 Occupation: Retired school teacher Description: 65-year-old white female Taught American History, Member (not active) of Gray Panthers…a senior citizens’ rights organization Family: Widowed; four grandchildren and five great grandchildren

Juror #9 Occupation: City Planner Description: 48-year-old- Hispanic male, very religious, ran for School Board two years ago and lost. Family: Wife is a public defender, three children

Juror #10 Occupation: Unemployed Description: 20-year-old black female, previously employed as a salesperson, one year of college, brother arrested for cocaine possession—entered drug rehabilitation program where he is recovering. Family: Divorced

Juror #11 Occupation: Supermarket checker Description: 44-year-old white male, Member of supermarket workers union, arrested for free speech, activities in anti-Vietnam demonstrations 25 years ago; case dismissed Family: divorced two children

Juror #13 Occupation: School Bus Driver Description: 35 year old black male, foreman of a jury in a criminal matter, 11 th grade education. Family: single

Lets Pick Your Jury! Rank your jury members, identify the two jury members you will strike from the other side. The prosecution will announce their first selection. The defense will follow with their first selection. Continue this process until eight jurors are selected for each side. The prosecution will then choose to strike one juror from the defense side. The prosecution will then announce their alternate juror… continue this process for the defense.
