NISD Student Code of Conduct Category I - Offense for which a student SHALL BE expelled. Category II - Offense for which a student MAY BE expelled or SHALL BE placed in a DAEP. Category III - Offense for which a student SHALL BE placed in a DAEP. Category IV - Offense for which a student MAY BE placed in a DAEP or suspended.

Category I Offenses: Mandatory Expulsion Firearm Illegal Knife, Club, or Prohibited Weapon Texas Penal Code Title V Felony (offenses against a person) Felony Drug or Alcohol Arson

Category II – Discretionary Expulsion/Mandatory DAEP Persistent Misbehavior DAEP Felony Criminal Mischief Assault w/Bodily Injury against Staff False Alarm Terroristic Threat Misdemeanor Drug/Alcohol Felony Weapon/Title V Felony within 300 feet of school property.

Category III – Mandatory DAEP Assault w/ Bodily Injury to student Public Lewdness/Indecent Exposure Deferred prosecution, jury finding, or reasonable belief that a Title V Felony has been committed regardless of location.

Category IV – Discretionary DAEP and/or Suspension Persistent Misbehavior Serious Fight Profanity directed at staff Extreme, Flagrant Insubordination Theft Criminal Mischief AUP Violation Disruption to the school environment Reasonable belief that a Non-Title V Offense has been committed regardless of location
