Sector San Francisco What We Do:  Investigate Oil & Chemical Spills in the Coastal Zone  Monitor Salvage & Enforce Clean-up Operations  Perform Harbor Patrols  Assistance with Prevention & Planning  Provide Training and Exercises to Government Partners

Sector San Francisco Response to Oil Spills  Basic Authority: Under FWPCA 33USC1321  Any oil that produces a sheen in the water is a violation.  If it is a mystery sheen (no suspected source/RP), we may investigate via phone depending on the circumstances.

Sector San Francisco Response to Chemical Releases  CERCLA: 40CFR302.4  Any hazmat released over the Reportable Quantity.  Or dangerous to life/health or the environment.

Sector San Francisco IMD Personnel Qualifications  Pollution Investigator (PI)  Responds to and investigates spills.  Enforces regulations.  If a spill becomes larger/federalized, hands case over to FOSCR.  Federal On Scene Coordinator’s Representative (FOSCR)  Supervises federalized or larger spills.  Completes cost documentation.

Sector San Francisco What is the NRC?!  Coast Guard National Response Center  What happens when I call them?  You or the reporting party gives them all the information about the spill.  This gets forwarded to all applicable agencies- OES, CG, EPA, DFG… etc.

Sector San Francisco Federalized Cases  Why do we federalize?  If the Responsible Party (RP) does not take responsibility for cleanup (or if we cannot find the RP).  OSTLF: Oil Spill Liability Trust Fund  Fund can be opened for oil spills or an imminent and substantial threat.  CERCLA: Comprehensive Environmental Release Compensation Liability Act  Fund can be opened for chemical releases and unknown hazards.

Sector San Francisco Enforcement  Letter of Warning: 5 elements, first time offense in past year, non commercial source <50 gal, commercial <25 gal.  Notice of Violation: 5 elements, <1000 gal, fine up to $10,000, willing to accept.  Marine Violation (Class 1 & 2): 5 elements, any case, heard in front of hearing officer, can be up to $32,500 per violation.
