NFP reform agenda, and the role of the Australian Charities and Not-for-profits Commission David Locke Assistant Commissioner Charity Services 28 July 2012

Who will the ACNC regulate? Existing charities that currently access Commonwealth tax concessions Existing and new charities that want to apply for Commonwealth tax concessions and other benefits 56,000 charities, 10% of broader NFP sector Possibly other types of NFPs but not before 2014

ACNC functions Registration Reporting – Charity Passport, ‘Report once, use often’ Information Portal – ‘One-stop shop’ for charities and public Education and Advice Compliance

What does this mean for charities? Charities endorsed by the ATO will be automatically registered with ACNC from 1 October 2012 Ongoing eligibility will be reviewed following passage of the new charities definition legislation (1 July 2013) Annual information statement (initially only non- financial information) required of all registered charities from 1 July 2013 Financial reporting required for medium and large charities for period commencing 1 July 2014

What does this mean for charities? To reduce the compliance burden, core information will be provided to other Australian Government agencies via a Charity Passport (report once, use often) Searchable information on charities will be available to the public through Information Portal from 1 July 2013 Charities will be able to use the Portal as a one stop shop and have a free online presence Additional, tailored support will be available to charities

Education and advice Provide information, guidance and education via:  ACNC website including multi-media resources  Trained staff ( , telephone and social media) Aim to:  Explain the role of the ACNC and the new regulatory requirements for charities  Help the public learn more about charities and the ACNC

Registering charities Online smart form to collect: Information to assess an organisations eligibility to become a registered charity Information to display on the public portal Information to enable the Tax Office to assess an organisations eligibility for tax concessions
