Background The establishment of a competent regulatory body in Egypt goes back to 1982. In 1982 the Nuclear Regulatory and Safety Committee was established. This committee was transferred to be the National Center of Nuclear Safety and Radiation Control (NCNSRC) by the Decree of President No. 47 of 1991 which reorganized the Egyptian Atomic Energy Authority (EAEA).

NCNSRC Duties Reviewing and Assessment of the Safety Reports of Nuclear and Radiation Facilities. Conducting Regulatory Inspection for Nuclear and Radiation Activities. Carrying out Safeguard Inspection for Nuclear Materials. Issuing Licensing, Permit Authorization or Approval for Personnel or Facility or Procedure, or Safety Document. Developing Regulations, Rules and Procedures Related to Nuclear and Radiation Safety Issues. Control of Transportation of Radioactive Materials on- Land or in the Suez- Canal. Conducting Research in Areas relevant to Nuclear and Radiation Safety.

Nuclear Legislations Process The Egyptian Atomic Energy Authority (EAEA) performed a well organized process including several steps concerning the drafting of the Egyptian nuclear and radiation Law as follows:

Revision Steps Compilation and study of a documents related to the nuclear legislations and activities in several countries. Study of the relationship between the evolution of the nuclear activities and its legislation in the selected countries. Comparison of the country legislation in view of the IAEA Guidelines (Handbook of Nuclear Law). Assessment of the existing Egyptian nuclear/radiological legislations in view of the current and planned activities. Draw a conclusion on the Egyptian needs concerning its legislations.

Egyptian Nuclear and Radiation Law Egypt took the decision to have a comprehensive and unified Nuclear and Radiation Law reflecting the Egyptian obligations within its legally binding instruments that brought into force. The Law was already drafted within approximately two years covering safety, security, safeguards and liability for the whole peaceful applications of atomic energy. The President has already sent the Law to the Parliament for approval and it will be available soon.

Egyptian Nuclear and Radiation Law: Scope All nuclear and radiation facilities, practices and activities in the Arab Republic of Egypt shall exclusively be restricted to peaceful purposes.

Nuclear and Radiation Regulatory Authority (Under Construction) The new Law will establish an independent body to monitor all nuclear and radiation facilities, activities and practices known as "Nuclear and Radiation Regulatory Authority", having a public juridical personality, reporting to the President, having an independent budget and centrally located in Cairo.

Egyptian System of Accounting for and Control of Nuclear Material (ESAC) In 2006, the Presidential Decree no. 152 was issued to establish an Egyptian System of Accounting for and Control of Nuclear Material (ESAC). Three Executive Ministerial Decrees were also issued to put the implementation mechanism concerning the ESAC activities.

IAEA Action Plan Within the framework between the IAEA and Egypt, IAEA and the Egyptian Authorities have prepared an Action Plan to support the Egyptian’s ongoing activities concerning introducing nuclear power into the national energy mix.

IAEA Action Plan The Action Plan included the following areas: Overall project management Generic activities for the introduction of nuclear power Energy planning Legal and legislative framework Site evaluation Strengthening of the safety infrastructure Human resources development and public communication

Objective The main objective is to strengthen and enhance the effectiveness of the nuclear safety regime in Egypt through improvement of the NCNSRC organization and performance as one of the future TSOs, as well as the creation of a newly independent regulator (under construction).

Staffing Based on international consensus, licensing the first reactor takes about 40 staff, while oversight of one operating site takes about 30 staff. During the personnel selection process, 2 to 3 times the required number for each job will be considered to assure redundancy and to compensate the possibility of competent persons leave.

IAEA Mission: Recommendations Producing, documenting and approving a strategic plan for regulatory competence and human resources development focusing on regulations associated to the building of a NPP. It is recommendable that the strategic plan covers 5 to 10 years and gives an analysis of current staff, plans for recruitments and estimation of workload needed associated to the new NPP, in particular the more urgent regulatory competence to develop. Organize and/or outsource if necessary the design and implementation of the training programs. Asses and document the implementation of the training program, identifying areas to improve and feedback the strategic plan for the development of the regulatory competence. - Design and implement a program for building up in house knowledge and training resources

EAEA prepared an integrated document for the QA and management disciplines concerning the Egyptian Regulatory Framework. This document has been sent to the IAEA for revision. Egypt is still waiting for IAEA recommendations and/or suggestions. IAEA WS on the Management System of the Regulatory Body was held in Cairo on August, 2009 under Project EGY/9/038.

Current Status? Egypt is going to hire a consultant to help in different regulatory aspects including HR development and training related issues. Consultant shall prepare and plan for conducting all the training needs including on the job training in Egypt and abroad for RB staff. Terms of Reference (ToR) has been prepared by the EAEA Experts and sent to IAEA for revision. Egypt received the IAEA report including some suggestions and recommendations. A prequalification invitation for the Regulatory Consultancy services has been announced. Consequently, Egypt is in process to select the qualified international consultancy firms (short list) in order to issue the necessary limited tender.
