Oregon Sage-Con Direction LCDC Rules to Address Sage-Grouse Protection + ODFW Rules to Implement Mitigation for Impacts = USFWS Assurance of Regulatory Mechanisms

LCDC Rules (OAR ) Directs Counties to Establish Rules to Protect Sage-Grouse Habitat Provides Overarching Rules Establishes Limits of Impacts in Core Habitats- Measured by “Foot Print” Defines Large vs Diminimus Impacts in Sage- Grouse Habitat Establishes Mitigation Hierarchy for Addressing Development Which may Affect Habitat Directs Developer to ODFW for Required Mitigation

ODFW Rules (OAR ) Existing Rules – Population Management (30,000 birds next 50 years) – Habitat Management (70% in advanced sagebrush) – Conservation Approach (Map Core to protect 90% of population) New Rules – Mitigation in Sage-Grouse Habitats

Mitigation Rules Sets Mitigation to Address Direct and Indirect Impacts Establishes “Net Gain” Requirement Sets Standard That Mitigation is Based on “Functionality of Habitat to Support Population” Recognizes Need for Consistent Approach Opens Opportunity for In Lieu Program for Mitigation
