Provision & Demand for Allotments Review of Open Space, Sport, Recreation Facilities & Green Infrastructure in Rutland, by Sports Structures Ltd. (formed part of evidence base for Local Development Framework) Allotments…..provide opportunities for those people who wish to do so to grow their own produce as part of the long term promotion of sustainability, health and social inclusion Section 23 Small Holdings and Allotments Act 1908 Qualitative Quantitative Accessibility

Small Holdings and Allotments Act 1908 Councils of Districts and Parishes have allotment functions (S61 provides that Parish Councils includes references to Parish Meetings) RCC has direct allotment function only in non-parochial places A min of 6 electors can request allotments be provided to their Parish Council/Parish Meeting. Anyone aggrieved by refusal seek judicial review on breach of statutory duty, but no timelimits for provision so greater priorities could be argued in defence Any provision is based on demand at that time which may change and therefore those requesting are not guaranteed an allotment

Site Identification & Acquisition Identify potential sites, consider suitability of options Engage with landowners to seek voluntary purchase or lease Parishes could approach RCC to assist with this work which may be chargeable Where agreed acquisitions vest land in Parish Council or Trustees of Parish Meeting

Compulsory Hiring or Purchase If a voluntary acquisition cannot be agreed: compulsory hiring for a period of between 14 and 35 years (renewable). PC doesn’t have compulsory powers, would need to ask RCC to do it on its behalf. The PC would need to meet all costs. The land effectively would be let by RCC to the PC as a consequence. If RCC declined for some reason, the PC can approach the Secretary of State to make the hiring order direct (the SoS has to confirm compulsory hiring anyway). Compulsory purchase if hiring not appropriate
