Negotiating Through the Intellectual Property Issues in R&D Collaborations Presentation to FPTT Conference Montreal, 2003 May 30 Jeff Mackwood Marketing Manager NRC Aerospace

The Six Sharing Elements R&D Collaboration consists of six shared elements: there is a shared need to do the work there is a shared effort in defining the work there is a sharing in the doing of the work there is a sharing of the costs of doing the work there is a sharing of the results of the work and there is a sharing in the downstream benefits of having done the work.

Definition of Intellectual Property Intellectual Property (IP) is all rights and inventions (whether patentable or not), patents, copyright material, trade secrets, confidential information, and bacterial, viral, plant, human, or animal material that has new genetic or other characteristics first produced by a party.

Arising and Background IP Arising Intellectual Property results from the doing of the work of the project at hand. Background Intellectual Property exists before the project came along, or if it is created independent from the doing of the work.
