Understand your Risk The Site belongs to you It is your contamination, your wetlands, your silt, your drainage problem, ……. Your Engineer can not guarantee results

Sometimes it’s what you can’t see What site issues may impact your ability to develop? Existing Easements Covenants Deed Restrictions Access Boundary disputes Historic preservation Contamination from prior uses

Sometimes it’s right in front of you Soils Drainage Traffic Access, Impacts, and Circulation Fire Flows Sewer Capacity and Depth Ground Water Wetlands and Waters of the US Habitat for T&E Species Site Contamination

Sometimes it’s the Regulators FEMA – Flood Insurance Program COE – Clean Water Act DWR – State Drainage and water rights KDHE – Discharge permits, contamination issues, plan approval for sewer and water KDWP - Habitat Local – Zoning, platting, construction

Local Issues State law requires that “drainage” be addressed during the zoning process. Local Planning Boards are required to consider COE approval prior to zone changes. All platting processes include a requirement to assess impacts as a condition of approval – Can the site be served with sewer and water? What will happen to traffic flow? Can detention requirements be met?
