LGAF Implementation in ECA Region  In several years LGAF proved to be the most effective and credible assessment in land governance field which continues to evolve and develop, facilitate implementation of VGGT.  LGAF is a Diagnostic tool to assess the status of land governance at country level (regulatory framework and existing practices) using a participatory process. It is based on detailed analysis of available data that leads to evidence based policy decisions;  LGAFs implemented in ECA region demonstrated that the countries share a lot of similarities and common challenges but have different policy approaches.  Georgia: LGAF Implemented in 2011, 2012; Land Governance Monitoring Pilot 2013; Retrospective update  Ukraine: LGAF Implemented in 2012; Land Governance Monitoring started in 2015  Moldova: LGAF implemented in 2013  Azerbaijan: LGAF ongoing: Started in 2014  Croatia: LGAF ongoing: Started in 2015

How LGAF process moved forward in ECA Region  Georgia:  The new Government considered and implemented number of policy recommendations, initiated a new project together with the WB that addresses LGAF Policy Recommendation on land registration  Ukraine  The new Government is working on reforms in land governance field and is considering LGAF findings and recommendations as a guide  Moldova  Following LGAF assessment the Government of Moldova expressed interest in implementing Land Governance Monitoring as a regular and automatic system for monitoring the changes

Main Challenges Croatia ChallengesDescription Lack of unified data and service available for the whole country Historical evolution of land registry has led to development of nonhomogeneous data. Cadastral plans are in different coordinate systems for different areas. Borders of land plots are overlapping. Cadastral information is renewed in some areas but not the land book. Registration of rights is done based on old cadastral documents. Registration is done by the Municipal Courts and Cadastre is managed by State Geodesic Administration Lack of registered public utility infrastructure Establishment of Utility infrastructure Cadastre is provided by regulations however it is non-existent. Utilities are sporadically registered as changes in the Land Book. The lack of this information in registry significantly reduces the quality of the registered data and causes insecurity in rights between the owners of land and infrastructure. Completion of denationali- zation, conversion of “social ownership” and registration in the cadastre and land book 20 years ago Croatia has adopted regulations on denationalization and conversions of "social ownership". This process is still in progress. There is a lot of confusion and disputes about who owns the former "social ownership", often between the state and local governments. Registration of unambiguous owner in land book has not yet been conducted. Transfer of property to former owners is also not going fast enough. Creating a transparent system of mass valuation of real estates and related legislation There is no uniform method of property valuation In Croatia. There are several regulations that define rules how to perform property valuation, determine "market value”. There are different types of taxes on certain property however the taxes are not introduced on all property. Necessary prerequisite for introducing the changes is a transparent system of mass valuation. Land fragmentation and lack of land consolidation activities In the past, number of land policies led to fragmentation of land. Currently there are more than 14 million cadastral parcels that prevent development of efficient farming. Land consolidation activities were implemented in 70s but currently there is no legislation that would allow implementation of land consolidation.

Main Challenges Azerbaijan ChallengesDescription Considerable number of Illegal constructions There is significant number of illegal and non-documented constructions. Illegal construction is widely spread all around the country, but is especially critical in the capital city Baku and its suburb areas. According to assessment conducted early 2000s there were over 250 thousand illegal constructions in Baku which is the result of urban migration and social- economic situation. Illegal construction constrains their integration into taxation system as well as limits their involvement in land market development. Overlapping functions of State Institutions in land administration system One of the issues impeding development of the real estate/land sector of Azerbaijan is existence of overlap between state bodies (SCPI and SLMC) acting in the area of land registration and cadastre. Initial registration of land is carried out by the State Land and Cartography Committee while following transactions on land is done by the State Committee on Property Issues. However the State Land and Cartography Committee was abolished by the presidential decree dated Feb 5, 2015 and relevant cadastral and registration tasks were transferred to SCPI Lengthy and costly settlement of property disputes and its enforcement Extended settlement of real estate/land disputes is one of major challenges in land governance area. According to existing legislation the only mechanism for legal settlement of property disputes is court. Gaps in legislation, especially absence of concrete timeline for some special cases allows to extend court proceedings for extremely longer period. The second serious problem in this area is actual enforcement of court decisions. Low level of public awareness on property registration issues One of the key problems in land governance area is lack of population awareness on importance of cadastre and registration, available services as well as rights and responsibilities of owners. Although as a result of public awareness campaigns conducted recently the attitude of population to these issues have changed, the majority of citizens of the country are not interested in formalizing real estates under their ownership.

Developments around Land Governance Monitoring  LG Monitoring is still in testing mode to track the progress of LGAF assessment  Georgia - following LGAF assessment  Ukraine - following LGAF assessment  Croatia – being implemented in parallel with LGAF Monitoring Indicators  Number (and prices where possible) of registered transactions of different types;  Receipts of land tax revenue;  Share of communal, private, and state land mapped;  Cases of expropriation and privatization;  Number of land-related conflicts in the courts;  Share of agricultural/residential land registered and mapped in women’s/men’s name or in joint ownership

Steps towards ECA wide collaboration  In order to promote wider collaboration of donors and government on land governance issues UNECE, WB and UN FAO organized the Joint WS in Baku, Azerbaijan, November 28, “Benchmarking of land administration systems and implementation of Land Governance Assessment Frameworks (LGAF) in the UNECE region”  Moldova, Ukraine and Georgia presented updates on LGAF outcome;  Introduced Land Governance Monitoring, implementation methodology and results of the pilot in Georgia  Discussed the ways of LGAF, LG Monitoring and VGGT collaboration, how to complement each-other and facilitate their effective implementation;
