General Provision The University shall not seek ownership of copyrights or royalties resulting from said copyrights on any intellectual property created by the faculty and/or students that takes the form of traditionally published materials (e.g. books, textbooks, anthologies, monographs, novels, plays, musical scores, etc.) or traditional graphic materials (e.g. photograph, paintings, drawings, murals, etc.)

Incidental Institutional Support Included but not limited to: –Research stipends –Release time for professional development –Grant or stipend to develop new course –Grant or stipend to enhance an existing course Ownership –Creator unless stated in writing and signed before initiation of funding
Extraordinary Support Definition –Significantly more than normal or incidental Ownership –University Royalties –50%- 50% division between the University and Creator after paying for the costs Provisions may be overridden by agreement between parties
Dispute Resolution University Intellectual Property Committee (UIPC) Five members –Two selected by Provost –Three selected by Academic Senate UIPC make recommendations to the Provost and inform the Executive Committee at the same time
Disclosure AVP(R&GS) reviews the IP disclosure and make preliminary determination of the University ownership interest. Must complete review in 20 working days If Creator disagrees, UIPC must be convened. UIPC must make recommendation to Provost in 20 working days Provost has 20 working days to accept or reject the recommendation of UIPC. Provost shall inform UIPC and Executive Committee of the Senate of his/her decision When the University has ownership, an application for patent or copyright must be filed within a reasonable time period
