Harassment and Rape

sexual harassment Paradigm cases of mere sexual harassment include:  inappropriate whistling and teasing of a broadly sexual nature  inappropriate touches of a broadly sexual nature  inappropriate invitations of a broadly sexual nature What is it for a whistle, touch, etc. to be inappropriate?  Very roughly, they are inappropriate when they are unwelcome.

molestation and rape Paradigm cases of molestation include:  a pedophiliac forcing a child to perform or receive oral sex  one adult forcing another adult to receive oral sex  one sibling inappropriately touching another sibling in a broadly sexual manner Paradigm cases of rape include:  one person forcing another to have vaginal intercourse  one person forcing another to perform oral sex As this suggests, some instances of molestation count as instances of rape. Both are instances of sexual harassment. We’ll focus on two questions regarding rape:  What is rape?  What makes rape wrong?

what is rape? As always, to answer this question, we need to identify the essential characteristics of rape. Here are some candidates for necessary conditions: SEX: x rapes y only if x has sex with y. FORCE: x rapes y only if x forces y to have sex with x. Consider: Joe secures sex with Jane through the credible threat of force. COERCION: x rapes y only if x coerces y into having sex with x. Consider: Ted secures sex with Tanya through the use of the drug Rohypnol.

what is rape? EXP HARM: x rapes y only if x’s having sex with y is experienced by y as harmful. Consider: Tanya was unconscious when Ted had sex with her and possesses no memories of the event, and thus does not at any point experience the event as harmful. CONSENT: x rapes y only if y does not consent to having sex. Consider: Riley consents to having sex with Buffy but not Faith, who is pretending to be Buffy.  Question: Is this a genuine case of rape? CONSENT*: x rapes y only if y does not consent to having sex with x (as x).

what is rape? Is what is essential to rape SEX + CONSENT*?  If so, then rape = a certain sort of non-consensual sex: x rapes y iff (i) x has sex with y, and (ii) y does not consent to having sex with x (as x). Are (i) and (ii) sufficient for rape? Consider: Sue has drugged herself unbeknownst to Bob; Sue’s actions suggest that she wants to have sex with Bob though she really does not – it is the drug talking.

what is rape? BELIEF: x rapes y only if x does not believe that y consents to having sex with x (as x). Consider: Dave stubbornly deludes himself into believing that Dara consents to having sex with him despite her many vehement and explicit protests. BELIEF*: x rapes y only if x does not reasonably believe that y consents to having sex with x (as x).

what is rape? The foregoing investigation suggests that what is essential to rape are SEX, CONSENT*, and BELIEF*. x rapes y iff (i) x has sex with y, (ii) y does not consent to having sex with x (as x), and (iii) x does not reasonably believe that y consents to having sex with x (as x). Questions:  What about the prostitute case (Linekar)?  What about Telley in Kids?

the wrong of rape When considering the wrong of rape, it is important to distinguish between the following questions: Is rape always wrong? Is rape always a serious wrong, when it is wrong? In those cases in which rape is (a serious) wrong, why is it (a serious) wrong? We’ll discuss each in turn.

is rape always wrong? One might argue that just as killing is not always wrong, so, too, rape is not always wrong.  (A wrong is an unjustified harm.) Potential examples of wrongless rape include:  rape of someone who has at a previous time asked to be raped at a later time  rape which brings the victim extreme sexual pleasure and satisfies some sexual desire or fetish  rape in self-defense Even if we are willing to admit that certain (perhaps strange and remote) cases of rape are not wrong, it’s clear that most cases of rape are wrong.

is wrongful rape always a serious wrong? Non-serious wrongs include:  stealing a doughnut  killing a fly  lying to one’s professor about the reason for one’s absence  insulting someone  breaking one’s promise to wash the dishes Serious wrongs include:  armed robbery  murder  child abuse  kidnapping  slavery Paradigm cases of rape appear to be serious wrongs.

is wrongful rape always a serious wrong? Archard claims that “in people’s estimation of the seriousness of various crimes, forcible rape comes immediately below murder and above a serious assault or armed robbery.” What about non-forcible rape? Perhaps rape which brings the victim extreme sexual pleasure and satisfies some sexual desire or fetish is wrong. Even so, it is arguably less wrong than other instances of rape, in that it is not a serious wrong.

why is wrongful rape (a serious) wrong? Utilitarianism emphasizes the moral importance of producing the greatest consequences for the greatest number. Recall that utilitarianism applied to sexual activity is the view that the only morally acceptable sexual activity is that which does not produce negative utility (happiness/pleasure). So, sexual activity which produces negative utility (happiness/pleasure) is wrong.  Rape is wrong (when it is) because it produces more overall unhappiness/pain than happiness/pleasure. Rape is a serious wrong when it produces far more overall unhappiness/pain than happiness/pleasure.

why is wrongful rape (a serious) wrong? Kantianism emphasizes the moral importance of respecting dignity, which is grounded in the autonomy of rational beings. Recall that Kantianism about sexual activity is the view that the only morally acceptable sexual activity is that which does not involve treating others merely as a means. So, sexual activity in which someone is treated merely as a means to some other end is wrong.  Rape is wrong (when it is) because the victim is being treated merely as a means. Rape is a serious wrong when it involves a serious violation of the victim’s dignity (or sexual integrity).

why is wrongful rape (a serious) wrong? Virtue Ethics emphasizes the moral importance of the sort of person that one is. Virtue Ethics about sexual activity is the view that the only morally acceptable sexual activity is that which is consistent with the possession or development of good character. So, sexual activity that is inimical to the possession or development of good character is wrong.  Rape is wrong (when it is) because the action is inimical to the possession or development of good character. Rape is a serious wrong when it seriously undermines the possession or development of good character (sexual integrity).
