General review of the latest draft of the Renewable Energy Act Anna Kowalska

CURRENT SITUATION no separate regulation concerning renewable energy sources grid connection and support system for renewables regulated in the Energy Law Act legislative work to replace the Energy Law Act with 3 separate regulations for electricity market, gas and renewable energy

GENERAL INFORMATION ABOUT THE PROPOSED LAW implements Renewables Directive (Directive 2009/28/EC) provides means by which Poland is to reach the 15% share of renewables in total energy consumption in 2020

1. general specifications of the support scheme for renewable energy sources 2. grid connection 3. incentives and support for the development of micro-sources

SUPPORT SYSTEM SPECIFICATIONS 1. Suppliers of last resort must purchase energy from renewable sources connected to their networks at fixed prices. 2. Energy companies which sell electricity to final consumers are obliged to purchase specified quotas of certificates of origin and then submit them for redemption to the President of Energy Regulatory Office. 3. As an alternative, energy companies can pay a buy-out price. 4. The support scheme will last for 15 years. 5. The amount of support depends on technology used.

CERTIFICATE OF ORIGIN confirmation that the quantity of electricity determined in the certificate was generated in a licensed renewable energy source source of pecuniary rights transferrable commodity

CREATION OF A CERTIFICATE OF ORIGIN Renewable energy is generated Application is made to the President of the Energy Regulatory Office ( ERO ) ERO issues the certificate

NEXT STEPS Certificate can be sold on a licensed commodity exchange Energy company acquires certificates oror Energy company submits certificates for redemption Energy company pays buy- out price

renewable sources have priority over conventional sources when entering into grid connection agreements expenditure made by DSOs on grid connection is returned in TSO tariffs and reallocated between DSOs GRID CONNECTION RULES

no license needed grid connection free of charge energy company must purchase excess energy at a fixed price INCENTIVES AND SUPPORT FOR MICRO-SOURCES
