State Procurement Policy Board The Board has rule making authority consistent with the Procurement Code and will decide matters of policy relative to the Code The Board has no authority over the award or administration of any contract or dispute
Promulgate Rules Districts have independent procurement authority…. Which means the State Procurement Officer does not have authority over districts Districts are authorized to create their own purchasing policies. But if they fail, the Board will do it for them The state purchasing policies apply to all districts that do not create their own complete set of policies District policies may be submitted to the Utah State Procurement Policy Board for approval as complying with the revised Procurement Code
UASD Districts may use state rules or create their own for all types of procurement and purchasing There are many sections that include mandatory or optional rulemaking obligations or authority for districts The Association will prepare templates for purchasing policies We plan to go over the template at our convention in November 2013
Timing Effective date: May 1, 2013 Rule making proceedings must be initiated by May 13, 2014
