Definition An employment contract is a legally binding formal agreement between and employee and employer.
Three key features of a contract Acceptance: Employee agrees to these terms and conditions Offer: Employer offers Terms and conditions of employment Consideration: Benefits that both parties receive as a result of employment contract

The current industrial relations system Previously under the Workplace Relations Amendments (WorkChoices) Act 2005 there were a number of categories of workers for determining wages and conditions. These included: The safety net Certified agreements (union and non-union) Individual contracts (AWAs) Greenfield agreements (employer and union)
The current industrial relations system Under the FWA 2009 there is still the Safety Net but no individual contracts. The Safety Net for those workers unable to negotiate an enterprise agreement. These tend to be the least skilled workers All workers who are not governed by the safety net will fall under one of the following agreements: ◦Single-enterprise agreements ◦Multi-enterprise agreements ◦Greenfields agreements
Rights and entitlements of Employees Wages set by an award or agreement A safe and healthy workplace A discrimination free workplace A pay slip showing the total amount and how the pay was calculated No requirement to undertake illegal activity Employees Rights Annual leave – minimum 4 weeks paid holiday leave Sick leave – up to 5 – 10 days when proof of sickness is provided Paid public holidays if the business closes (does not apply to P/T employees) Long service leave – usually after 10 years of continual employment Other leave provisions such as parental leave, bereavement leave, etc Note: Casuals don’t get not have access to these benefits Employees Entitlements
