What is Cyberbullying? The use of information and communication involving electronic technologies to facilitate deliberate and repeated harassment or threat to an individual or group. Being cruel to others by sending or posting harmful material using technology means: –Power –Control –Human Relationships

Differences Bullying 1. DIRECT 2. Occurs on school property 3. Poor relationships with teachers 4. Fear retribution Physical: hitting, punching, shoving Verbal: Name calling, gossip Nonverbal: Use of gestures & exclusion Cyberbullying 1.Anonymous 2.Occurs off school property 3.Good relationships with teachers 4.Fear loss of technology privileges Further under the radar than bullying Emotional reactions cannot be determined

Disseminating matter Harmful to juveniles – Sending or showing pictures to a minor Sexting No person shall… –Directly sell, deliver, furnish, DISSEMINATE, provide, exhibit, rent, or present to a juvenile (minor), a group of juveniles, a law enforcement officer posing as a juvenile…any material or performance that is obscene or harmful to juveniles –…allow any juvenile to review or peruse any material or view any live performance that is harmful to juveniles (shows/pornography)

Penalties If convicted, even if a juvenile, the guilty person must register as a sex offender. This could remain on the person’s record for life, or a limited time, held to the discretion of the judge. Harmful – Misdemeanor of the 1 st degree Obscene – Felony of the 5 th degree Under 13 years of age – Felony of the 4 th degree (regardless of anything…no matter what) Exceptions: exhibit/medical situations only

Con’t A juvenile can’t determine if it’s (picture/video/live performance/pornography) harmful to them or not…this is determined by the law enforcement involved.
