The Military Personnel and Civilian Employees’ Claims Act (MPCECA) U.S. Coast Guard Claims and Litigation

The Military Personnel and Civilian Employees’ Claims Act (MPCECA): See COMDTINST M5890.9, Chapter 6. Provides authority for settlement of claims for the loss of, damage to, or destruction of certain property of military personnel or civilian employees occurring incident to their service. For incidents occurring primarily aboard Government property, or as a result of duty-related activities. Does not replace private insurance. U.S. Coast Guard Claims and Litigation

Claims by military members or civilian employees of the Coast Guard, are under the MPCECA, and should be submitted on the CG-4112, Personal Property Claim form.CG-4112, Personal Property Claim These types of claims do not normally require full administrative investigations. Instead, units should use the CG-4112A, Claims Investigating Officer’s Report of Personal Property Claim.CG-4112A, Claims Investigating Officer’s Report of Personal Property Claim Page 2 of the CG-4111, which is an inventory sheet, may also be requested by the Settlement Officer when the claim involves damage to several items. The Investigation: As soon as possible after an incident that might give rise to a claim against the Coast Guard, the responsible unit should undertake an investigation in accordance with the Administrative Investigations Manual (AIM), COMDTINST M as supplemented by Chapter 2 of the Coast Guard Claims and Litigation Manual, COMDTINST M Administrative Investigations Manual (AIM), COMDTINST M5830.1Coast Guard Claims and Litigation Manual, COMDTINST M In most claims matters, the preferred investigation format is the Letter Incident Report (LIR).
