CONSTITUTION ARTICLE 309 TO 323 OF THE CONSTITUTION MAKES ELABORATE PROVISIONS FOR CENTRAL AND STATE SERVICES THE CONSTITUTION, THEREFORE, SEEKS TO INCULCATE IN THE CIVIL SERVANT A SENSE OF SECURITY AND FAIR PLAY SO THAT HE MAY WORK AND FUNCTION EFFICIENTLY AND GIVE HIS / HER BEST TO THE COUNTRY

JUNIOR SCALEAPO……… i)50% OF THE VACANCIES IN JUNIOR SCALE SHALL BE FILLED BY DIRECT RECRUITMENT THROUGH AN OPEN COMPETITIVE EXAMINATION HELD BY THE COMMISSION IN THE MANNER PRESCRIBED IN SCHEDULE II ii)50% OF THE VACANCIES IN JUNIOR SCALE SHALL BE FILLED BY SELECTION ON MERIT FROM GROUP ‘B’ OFFICERS WITH AT LEAST 3 YEARS IN SERVICE

ANNUAL PERFORMANCE APPRAISAL REPORT i)GOVERNMENT HAVE ACCEPTED THE PRINCIPLE THAT CONFIRMATION, PROMOTION, ETC. SHOULD BE BASED ON THE ASSESSMENT OF THE CONFIDENTIAL DOSSIERS, THIS MATTER IS OF THE GREATEST IMPORTANCE FOR THE EFFICIENCY AND MORALE OF THE SERVICES ii)IT IS VERY IMPORTANT BOTH IN THE INTEREST OF EFFICIENCY OF THE SERVICE AND ALSO OF THE OFFICERS THAT REPORTS ARE WRITTEN WITH GREATEST POSSIBLE CARE SO THAT THE WORK, CONDUCT, CHARACTER AND CAPABILITIES OF THE OFFICER REPORTED CAN BE ACCURATELY JUDGED FROM THE RECORDED OPINION

DEPARTMENTAL PROMOTION COMMITTEE (DPC) A POST IS FILLED BY PROMOTION WHERE THE RECRUITMENT RULES SO PROVIDE. IN MAKING PROMOTIONS, IT SHOULD BE ENSURED THAT SUITABILITY OF THE CANDIDATE FOR PROMOTION IS CONSIDERED IN AN IMPARTIAL MANNER. FOR THIS PURPOSE, DPCs ARE CONSTITUTED / FORMED

DPCs………. MEMBERS INCLUDED IN DPC FOR GROUP ‘A’ & GROUP ‘B’ POST SHOULD BE OFFICERS WHO ARE AT LEAST ONE STEP ABOVE THE POST IN WHICH PROMOTION IS TO BE MADE

DPCs………. A VACANCY SHALL BE FILLED IN ACCORDANCE WITH THE RECRUITMENT RULES IN FORCE ON THE DAY OF THE VACANCY UNLESS RULES MADE SUBSEQUENTLY HAVE BEEN EXPRESSLY GIVEN RETROSPECTIVE EFFECT

DPCs………. THE VACANCIES TO BE TAKEN INTO ACCOUNT SHOULD BE THE CLEAR VACANCIES ARISING IN A POST / GRADE / SERVICE DUE TO DEATH, RETIREMENT, RESIGNATION, REGULAR LONG-TIME PROMOTION AND DEPUTATION OR FROM CREATION OF ADDITIONAL POST ON LONG TERM

DPCs………. PURELY SHORT-TERM VACANCIES CREATED AS A RESULT OF OFFICERS PROCEEDING ON LEAVE OR ON DEPUTATION FOR A SHORTER PERIOD, TRAINING, ETC. SHOULD NOT BE TAKEN INTO ACCOUNT FOR THE PURPOSE OF PREPARATION OF A PANEL

DPCs………. THE ELIGIBILITY DATES FOR DETERMINING THE ELIGIBILITY OF OFFICERS FOR PROMOTION WOULD BE THE FIRST DAY OF THE CRUCIAL YEAR, i.e., JANUARY 1 st IRRESPECTIVE OF WHETHER ACRs ARE WRITTEN FINANCIAL YEAR-WISE OR CALENDAR YEAR-WISE

DPCs………. WHILE SENDING DPC PROPOSAL TO THE UPSC, A STATEMENT SHOWING THE PENALTIES IMPOSED ON THE OFFICERS WITHIN THE ZONE OF CONSIDEREATION ARE REQUIRED TO BE PLACED IN THE APAR FOLDERS OF THE CONCERNED OFFICERS

FURNISHING OF INTEGRITY CERTIFICATE THE INTEGRITY CERTIFICATE ON THE LINES INDICATED BELOW IS REQUIRED TO BE FURNISHED TO THE DPC : “THE RECORD OF SERVICE OF THE FOLLOWING OFFICERS WHO ARE TO BE CONSIDERED FOR PROMOTION / CONFIRMATION IN THE GRADE HAVE BEEN CAREFULLY SCRUTINISED AND IT IS CERTIFIED THAT THERE IS NO DOUBT ABOUT THEIR INTEGRITY”

INTEGRITY CERTIFICATE………… IN CASES, WHERE UPSC IS ASSOCIATED WITH THE DPC, THE CERTIFICATE WILL BE RECORDED BY AN OFFICER NOT BELOW THE RANK OF DEPUTY SECRETARY TO THE GOVERNMENT OF INDIA

DPCs………. DOP&T VIDE THEIR OM DATED 8 th FEBRUARY, 2002 HAVE STATED THAT IT HAS BEEN DECIDED BY THE GOVERNMENT THAT THERE SHALL BE NO SUPERSESSION IN THE MATTER OF PROMOTION OFFICERS ARE TO BE GRADED BY DPCs AS ‘FIT’ OR ‘UNFIT’ WITH REFERENCE TO THE PRESCRIBED BENCHMARK AND THOSE FOUND ‘FIT’ ARE TO BE INCLUDED IN THE PANEL AS PER THEIR SENIORITY IN THE FEEDER GRADE

ZONE OF CONSIDERATION A ZONE OF CONSIDERATION IS ESSENTIALLY REQUIRED TO ENABLE THE DPC IN MAINTAINING A PROPER FOCUS. THE ZONE SHOULD BE WIDE ENOUGH TO CATER TO THE NEEDS OF THE DEPARTMENT AND FOR GIVING AN EXTENDED PANEL AGAINST EMPANELLED OFFICERS WHO ARE ON DEPUTATION AND ALSO TO TAKE CARE OF THOSE OFFICERS IN THE FEEDER GRADE WHO ARE PLACED IN SEALED COVER

ZONE OF CONSIDERATION…….. THE METHOD OF FIRMING UP THE NUMBERS OF CANDIDATES FOR THE ZONE OF CONSIDERATION TO BE CONSIDERED BY THE DPC

ZONE OF CONSIDERATION…….. * FOR VACANCIES BEYOND 10, THE ZONE OF CONSIDERATION WILL BE ONE AND A HALF TIMES THE NUMBER OF VACANCIES PLUS THREE ( x 1.5) + 3 NO. OF VACANCIESNO. OF OFFICERS TO BE CONSIDERED *33

ZONE OF CONSIDERATION…….. THE PROVISIONS RELATING TO EXTENSION OF FIELD OF CHOIC TO FIVE TIMES THE NUMBER OF VACANCIE SIN RESPECT OF SC/ST OFFICERS ARE NOT FOUND IN THE NORMAL ZONE OF CONSIDERATION

GUIDELINES FOR DPCs WHILE MERIT HAS TO BE RECOGNISED AND REWARDED, ADVANCEMENT IN AN OFFICER’S CAREER SHOULD NOT BE REGARDED AS A MATTER OF COURSE BUT SHOULD BE EARNED BY THE DINT OF HARD WORK ETC. AS REFLECTED IN THE APARs “AVERAGE” MAY NOT BE TAKEN AS AN ADVERSE REMARKS, AT THE SAME TIME, IT CANNOT BE REGARDED AS COMPLEMENTORY TO THE OFFICER. IT IS ONLY PERFORMANCE ABOVE AVERAGE REALLY NOTEWORTHY WHICH SHOULD ENTITLE AN OFFICER FOR PROMOTION

GUIDELINES - DPCs………. THE DPC SHOULD CONSIDER APARs FOR EQUAL NUMBER OF YEARS IN RESPECT OF ALL OFFICERS CONSIDERED FOR PROMOTION THE DPC SHOULD ASSESS THE SUITABILITY OF THE EMPLOYEE FOR THE PROMOTION ON THE BASIS OF THEIR SERVICE RECORD WITH PARTICULAR REFEENCE TO THE APARs FOR PRECEDING FIVE YEARS IRRESPECTIVE OF THE QUALIFYING SERVICE PRESCRIBED IN SERVICE / RECRUITMENT RULES

GUIDELINES - DPCs………. WHERE ONE OR MORE APARs HAVE NOT BEEN WRITTEN FOR ANY REASON DURING THE RELEVANT PERIOD, THE DPC SHOULD CONSIDER THE APARs OF THE PRECEDING PERIOD IN QUESTION AND, IF, IN ANY CASE, THESE ARE ALSO NOT AVAILABLE, THE DPC SHOULD TAKE THE APARs OF THE LOWER GRADE INTO ACCOUNT TO COMPLETE THE NUMBER OF APARs REQUIRED

GUIDELINES - DPCs………. THE DPC SHOULD NOT BE GUIDED NEARLY BY THE OVERALL GRADING, THAT MAY BE RECORDED IN THE APARs BUT SHOULD MAKE ITS OWN ASSESSMENT ON THE BASIS OF THE ENTRIES IN THE APARs BECAUSE IT HAS BEEN NOTICED THAT SOMETIMES OVERALL GRADING IN AN APAR MAY BE INCONSISTENT

BENCHMARK IN THE CASE OF PROMOTIONS FROM GROUP ‘B’ TO GROUP ‘A’, THE BENCHMARK IS “GOOD” NORMALLY, IF AN OFFICER HAS FOUR “GOOD”, HE OR SHE MAKES THE GRADE

BENCHMARK……… THE DPC SHALL DETERMINE THE MERIT OF THOSE BEING ASSESSED FOR PROMOTION WITH REFERENCE TO THE PRESCRIBED BENCHMARK AND ACCORDINGLY GRADE THE OFFICERS AS “FIT” OR “UNFIT” ONLY ONLY THOSE GRADED “FIT” BY THE DPC SHALL BE INCLUDED & ARRANGED IN THE SELECT PANEL IN ORDER OF THEIR INTER-SE-SENIORITY IN THE FEEDER GRADE

DPCs………. THUS, ONE CAN SEE THAT THERE WILL BE NO SUPERSESSION IN PROMOTION AMONG THOSE WHO WERE GRADED “FIT” BY THE DPC

INSTRUCTIONS WITH REGARD TO RETIRED EMPLOYEES NAMES OF THE RETIRED OFFICIAL MAY ALSO BE INCLUDED IN THE PANEL, HOWEVER, SUCH RETIRED EMPLOYEES WILL HAVE NO RIGHT FOR ACTUAL PROMOTION

EXTENDED PANEL DPCs SHALL PREPARE AN EXTENDED PANEL ONLY IN THE FOLLOWING CASES : WHEN OFFICERS INCLUDED IN THE PANEL ARE NOT AVAILABLE FOR FULL VACANCY YEAR

REVIEW DPC IN CASES WHERE VACANCIES HAVE NOT BEEN REPORTED DUE TO ERROR OR OMISSION OR SOME OTHER FACT COMES TO LIGHT WHICH MAY RESULT IN INJUSTICE TO THE OFFICERS, THEN IN ALL SUCH CASES, A REVIEW DPC SHOULD BE HELD KEEPING IN MIND THE TOTAL VACANCIES IN A YEAR

REVIEW DPC………. IT NEEDS TO BE KEPT IN MIND THAT A REVIEW DPC IS EFFECTIVE FROM THE DATE OF THE ORIGINAL DPC EVEN THOUGH IT MAY HAVE BEEN HELD LATER FURTHER, SUCH DPC SHOULD CONSIDER ONLY THOSE PERSONS WHO WERE EILGIBLE AS ON DATE OF THE MEETING OF THE ORIGINAL DPC

WHEN GOVERNMENT SERVANT UNDER CLOUD AT THE TIME OF CONSIDERATION OF PROMOTION, DETAILS OF GOVERNMENT SERVANTS UNDER SUSPENSION, AGAINST WHOM CHARGE SHEETS HAVE BEEN ISSUED AND DISCIPLINARY PROCEEDINGS ARE PENDING MUST BE SPECIFICALLY BROUGHT TO THE NOTICE OF THE DPC

CHANGE……. TO BRING ABOUT COMPLETE TRANSPARENCY IN THE METHODOLOGY OF PROMOTING OFFICERS TO GROUP ‘A’ SERVICES BOARD HAVE DECIDED THAT HENCEFORTH INDUCTION INTO GROUP ‘A’ SHOULD BE CARRIED OUT ON THE BASIS OF A INTEGRATED SENIORITY LIST OF GROUP ‘B’ OFFICERS
