Surety Bonds 4 A surety bond is an instrument under which one party guarantees to another that a third will perform a contract. 4 Surety bonds used in construction are called contract bonds.

What is surety bonding? A careful, rigorous, and professional process in which surety companies prequalify contractors and then assure project owners that these contractors will perform the contract according to its terms and conditions at the contracted price, deliver on schedule, and will pay certain laborers, subcontractors, and suppliers associated with the project.

The Bid Bond provides financial assurance that the bid has been submitted in good faith and that the contractor intends to enter into the contract at the price bid and provide the required performance and payment bonds

The Performance Bond protects the obligee from financial loss should the contractor fail to perform the contract in accordance with the terms and conditions of the contract documents

The Payment Bond guarantees that the contractor will pay certain subcontractors, laborers, and material suppliers associated with the project
