India is a democratic country & democracy requires informed citizenry & transparency of information which are vital to it’s functioning & also to contain corruption & to hold govt. & their instrumentaries accountable to the governed. The right to information is implicity guaranteed by the constitution. However, with a view to set out a practical regime for securing information, the Indian parliament enacted the Right To Information Act, 2005 & thus gave a powerful tool to the citizens to get information from the govt. as a matter of right.
It means the statutory right of a citizen of India to seek information from the govt. & Public sector offices, institutions & non-govt. organisations which are situated in India & are owned, controlled or substantially financed by funds provided directly or indirectly by the Central Govt. or State Govt, regarding their functions & activities.
To provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities. To promote transparency & accountability in the working of every public authority. To set up Central & state Information Commission for the matters concerned therewith. To contain corruption & to hold govt. & their instrumentalities accountable to the governed. To harmonise revelation of information with public interests.
This act may be called Right to Information Act This act defines Appropriate Govt. which may be termed as Public authority. This public authority is controlled, owned or established by funds provided directly or indirectly by the Central Govt. or the Union Territory. This act requires the public authority & it’s officers to maintain & keep ready its records & machinery so as to facilitate the right to information. This act is applicable to all public authorities.
Public authority means any authority, body or institution of self-govt., established or constituted- By or under the constitution By any other law made by the Parliament By any other law made by State Legislature By the notification issued by the Central Govt. & includes any- Body owned, controlled or substantially financed Non-Govt. organisation substantially financed, directly or indirectly by funds provided by the appropriate govt.
