Tennessee Sex Offender Registry Zhenya Teal & Karrie Stanfill Intelligence Analyst August 11, 2014

History of the Sex Offender Registry Jacob Wetterling Act established registries for law enforcement purposes: effective in TN in 1995 Megan’s Law (Megan Kanka) established registries for use by the public: effective in TN in 1997 Bullets Jacob Wetterling Act- State registries; a boy kidnapped at 11 in 1989 in MN Megan’s Law- info available to public; raped and murdered by her neighbor at age 7 in 1994 in NJ

History of the Tennessee Sex Offender Registry Law … Prior to August 1, 2004, TBI registered all sex offenders in Tennessee. There was no fee. TBI mailed out monitoring forms quarterly. Offenders were required to sign the form and return it. Offenders did not meet face-to-face with any law enforcement. Because of our lax laws, TN became a haven for sex offenders.

Sex Offender Registry “The Tennessee Sexual Offender and Violent Sexual Offender Registration, Verification, and Tracking Act of 2004”TCA 40-39-201 et seq.

Who is required to register? Anyone convicted of a Tennessee Sexual/Violent Sexual Offense Anyone who establishes a physical presence, establishes a residence, accepts employment, or attends school (out of state offenders) Judicial Diversions now register (only required to register for the length of their diversion unless they violate the conditions of diversion) Juveniles, adjudicated of certain offenses

Tennessee Classifications Tennessee offenders are divided into three categories: sexual offender, violent sexual offender, or violent juvenile sexual offender.

2014 Updates: Public Chapter 770: Creates a new class of sex offender called an “offender against children”. This offender qualifies as an “offender against children” if his victim is 12 years of age or under. “Offenders against children” are required to remain on the Registry for life. This bill also adds the offense of “aggravated sexual battery” to the juvenile registry. Takes effect July 1, 2014.

Sexual Offenders Report in person once a year These offenders are eligible to apply to be removed from the registry 10 years after the expiration of their sentence, providing they have complied with the provisions of the registry and their victim was not 12yo or under.
