What Questions To Ask Departments Hosting a J-1 Scholar 1.What will the visitor be doing at KSU? (to know what category to assign) 2.What is the scholar’s start and end dates for the visit? (to know the minimum and maximum amount of time) 3. Who will be funding the visit? (KSU, the visitor’s home government, the visitor’s home institution, etc.) 4. Has the visitor held a previous J status? (to know if there are any restrictions) 5. Where will the visitor be housed once at KSU?

J-1 Professor/ Research Scholars Must Not !!! Be a candidate for tenure track position

Professor Teach, Lecture, Observe or Consult Minimum – 3 weeks Maximum – 5 years Research Scholar Conduct Research, Observe or Consult in conjunction with a research project Minimum – 3 weeks Maximum – 5 years Short-Term Coming to the U.S. on a short-term visit to lecture, research, observe, consult or teach Minimum - 1 day Maximum - 6 months Specialist Expert in a field of specialized knowledge or skill to observe, consult, demonstrate Minimum – 3 weeks Maximum - 1 year KSU Categories

BARS Only effect scholars wanting to start a new period of the J-1 Research Scholar or Professor category 1.12 Month Bar – Individuals who have been in the USA for more than 6 months in the previous year (12 months) in J visa status are not eligible to enter the USA as a J-1 Research Scholar or Professor for a 12 month period. – Time spent in the J-1 Short-term Scholar category does not count towards the 12 month bar Month Bar – Any Individual who participates in a J-1 or J-2 exchange visitor program in the Research or Professor category is subject to wait for 24 months before he/she can repeat participation in another Professor or Research Scholar category.

12 Month Bar The 12 Month Bar is not a home residence requirement. Required minimum period out of J status may be spent Outside US, or Inside US (in another nonimmigrant status)

24 Month Bar on Repeated Visitors The 24 Month Bar applies under 2 circumstances: 1.If the Professor or Research Scholar completes a full five years of program participating with one or more sponsors. 2.If, before the full 5 year period is over, The Professor or Research Scholar completes his or her program, The five year period is broken, and The five-year window is “closed” Then the individual is not eligible to access the remaining unused time, and must wait for two years before beginning a new program as a J Professor or Research Scholar.

J-1 Visa Application Process Host Department Contacts EAO Office to discuss hosting a J-1 scholar Host Department Submits necessary documents to EAO. RO/ARO verifies person is eligible for J-1 VISA. Continue to number 3 if scholar is teaching and paid by KSU Online Hiring Host Department submits Online Hiring Information is then forwarded to Human Resource and Academic Affairs. Estimated Time = 1 – 2 months Academic Affairs Approves teaching position and issues Offer letter Human Resources Approves hiring / Checks for Tax Treaties 4 DS2019 is prepared in SEVIS 5

Scholar Orientation The Role and Responsibility of J -1  Understand the Student and Exchange Visitor Information System (SEVIS)  Attend check-in and orientation at EAO  Ensure that your personal data is correct  Make normal progress toward completing the exchange program activity  Abide by the rules and maintain your legal J status  Maintain health insurance coverage  File form 8843 with the internal revenue service (IRS)  Report any proposed changes in your program activity  Contact your advisor at EAO for employment authorization  Extensions  Transfers  Report to EAO if you are interested in applying for a different immigration status

Orientation cont.  Change of nonimmigrant status or adjustment of status to permanent resident  Keep your passport and dependent passports valid at all times  Domestic travel  Obtain a travel endorsement signature when traveling outside the U.S  Dependents must travel with you if more than 30 days  Re-entry into the U.S.  Report the end of your program  Remain in the U.S. for no longer than 30 days  Submit copies of your passport, visa, DS2019, 1-94 and insurance to EAO
