How Planning Works A development team approach to all building proposals in Kennet. How to apply for planning permission and building regs approval. Sketch out some ideas of the building works you want to do. Discuss these with a builder to make sure they are feasible. Fill in the “Do I need to make a planning application?” form and send the information to us. We aim to give you a free written reply within 10 working days. Some building works or changes of use do not require planning permission. We cannot give verbal advice because every case is different.

Planning Services Charter The purpose of the charter is to set out clearly what the planning service provides and the standards that users of the service can expect to receive. Reply to all written communication, including s and faxes, within 10 working days Deal with all telephone calls within 24 hours Notify occupiers of premises most likely to be affected by an application by letter Right to speak at the Regulatory Committee Send details of the final decision made, including details of any conditions or reasons for refusal.

A Plan Led System Planning legislation since 1990 requires that planning decisions must be made in accordance with the development plan unless material considerations indicate otherwise.

Local Plan Policies and Proposals Examples of planning matters contained in the local plan that should be used to make planning decisions Landscape, countryside & habitat protection Sites allocated for housing, employment etc. Provision of affordable housing Highway safety, access and parking Design, appearance and layout Provision of recreation, education & community facilities Conservation, listed buildings and archaeology. Noise, dust, smell and pollution risks.

Material Considerations In addition to local plan policies, councils are also required to take account of other factors that may influence the decision they make. These are called “material considerations”. They can include the following: Government guidance notes (PPG & PPS) Precedent (where the same situation exists, the decision should be the same) Appeal decisions & court decisions The planning history of a site Planning gain

Affordable housing policies a) national policy It is legitimate to seek an element of affordable housing on suitable sites. Need to meet the housing requirements of the whole community. In rural areas every new market house should be matched with an affordable one

Affordable housing policies b) where? Housing allocations On previously developed land Re-use of vacant buildings Sites in villages with a range of facilities Rural exceptions policy sites not otherwise allocated, also edge of village

Affordable housing policies c) targets HC28: subsidised affordable homes 200 low cost market homes

Affordable housing d) allocated and urban sites +25 houses or +1 hectare +15 houses or +1/2 ha in Marlborough 30% subsidised rented (RSL) 20% low cost market (at or below lower quartile market value subject to affordability re average incomes)

Affordable housing e) rural sites HC32: equivalent provision of general market and affordable homes (1:1) subject to evidence of local need In accordance with Rural White Paper RSL, village trust or similar

The Local Development Framework Local plans replaced with local development documents - LDF The LDF comprises several documents, known as Local Development Documents (LDD), each to be prepared separately. Each LDD has 3 key stages:- issues and evidence base; options; and preferred option. Consultation is required for each LDD at each of these three stages.
